Pelbagai perkara penting berlaku sepanjang tahun 2008 yang turut mewarnai kehidupan rakyat negara ini. Berikutan disajikan sepuluh berita terpenting sepanjang tahun ini.

Meruntuh benteng halangan

Semuanya bermula sebagai satu perjuangan kecil sekumpulan penduduk membantah tindakan syarikat konsesi lebuhraya untuk menutup jalan pintas ke kawasan mereka. Tetapi, ia akhirnya telah
mencetuskan 'pergelutan kuasa' di peringkat tertinggi yang berakhir dengan suatu berita gembira.

Mengimbas kembali ke tahun 2005 apabila para penduduk Bandar Mahkota Cheras bangun menentang tindakan syarikat konsesi lebuhraya di situ, Grand Saga Sdn Bhd menutup jalan pintas ke tempat mereka.

Syarikat konsesi itu telah membina benteng konkrit untuk menutup jalan pintas tersebut. Penduduk terpaksa mengambil laluan yang jauh dari rumah mereka, melalui kesesakan lalulintas serta terpaksa membayar tol di lebuhraya berkenaan.

Mereka menubuhkan jawatankuasa bertindak dan memfailkan saman terhadap syarikat konsesi berkenaan. Mereka mendapat sinar harapan apabila kerajaan Selangor jatuh ke tangan Pakatan Rakyat selepas pilihanraya umum Mac lalu.

Dokumen menunjukkan bahawa benteng tersebut terletak di atas tanah kerajaan negeri. Maka pegawainya telah mengarahkan supaya benteng itu dibuang. Penduduk merobohkan benteng itu pada 21 April, tetapi Grand Saga membina semula dua minggu kemudiannya, dengan diawasi oleh kira-kira 200 anggota polis.

Pergaduhan berlaku, dan yang paling teruk ialah pada 27 Mei, di mana lebih 10 orang cedera parah. Juruteknik Chang Jiun Haur mendakwa dia telah dipukul berulangkali oleh anggota polis.

Polis pula mendakwa, Chang melanggar seorang pegawai polis dengan keretanya, ketika hendak beredar dari tempat kejadian, dan menyiasatnya atas tuduhan percubaan membunuh. Bagaimanapun, dia kemudiannya didakwa atas tuduhan memandu secara berbahaya.

Campurtangan kerajaan negeri menyebabkan kerajaan pusat mengubah pendiriannya, yang sebelum ini dilihat lebih memihak kepada syarikat konsesi lebuhraya tersebut.

Ketika melawat kawasan terbabit, Menteri Kerjaraya, Datuk Mohd Zin Mohamed mengumumkan bahawa jalan pintas itu akan dibuka sehinggalah mahkamah selesai mendengar saman yang difailkan oleh penduduk terbabit.

Suruhanjaya Hak Asasi Manusia Malaysia (Suhakam) mengadakan siasatan awam terhadap tuduhan penggunaan "kekerasan yang keterlaluan" terhadap Chang. Laporan hasil siasatan itu belum diumumkan.

APA SETERUSNYA: Ia merupakan satu penantian yang mendebar di kalangan penduduk umumnya dan Chang khususnya.

Bandar Mahkota Cheras inquiry: Mechanic says he was beaten by FRU (updated)

KUALA LUMPUR: The Human Rights Commission of Malaysia's (Suhakam) two-day public inquiry into the allegation of excessive use of force by law enforcement personnel at Persiaran Bandar Mahkota Cheras 1, Bandar Mahkota Cheras on May 27 began Wednesday.

The first witness of the alleged assault by FRU personnel at the disputed Bandar Mahkota Cheras barricade in May claimed that he stopped his car before making a U-turn as there were cars in front of him when he saw at least 10 FRU personnel carrying batons and shields rushing to his car.

Chang Jiun Haur, who is a 23-year-old mechanic, said the FRU personnel kicked his car door, hit the passenger door window screen and opened the door before he was forcibly dragged out by at least five personnel who later beat him until he lost consciousness.

"Four to five persons pulled my T-shirt. They dragged me out of my car, threw me on the ground and beat me up. I couldn't see their faces. They were wearing helmets. I did not have time to see their identification. I was beaten on my face, head, arm and back with something very solid and hard. I couldn't do anything when they beat me," said Chang.

He was replying to a question by Suhakam commissioner Datin Paduka Zaitoon Othman on how the alleged assault took place.

Asked how he knew that they were FRU personnel, Chang said: "They were wearing the uniforms."

Chang who claimed that he was passing by the area with his younger sister Jiun Mein, 21 and two other friends Chan Siew Meng and Chok Kem Hoo at 11.30pm from his home in Persiaran Mahkota Cheras, said he was scared when the personnel kept on kicking his car while shouting, keluar, keluar (come out, come out).

Chang said he regained consciousness at Kajang Hospital where he was admitted for one day and he was brought to Seremban Hospital by his father the following day to have an X-ray examination done. He lodged a police report on the matter at the Seremban police station on May 29.

On June 10, Chang was charged with reckless driving during the incident at Bandar Mahkota Cheras.

Gan Ping Sieu, the lawyer representing Chang, his sister and his two friends, said after getting Suhakam's report on the findings of the alleged assault, his client would proceed with legal action against the police and the Government.

"In any event, my clients will proceed with the civil suit," said Gan, who is also MCA Youth legal bureau head.

Gan said he had written on behalf of his clients to Inspector-General of Police Tan Sri Musa Hassan and the Home Ministry to take action against the personnel but so far no action had been taken.

"It is very regretful that there has been no response from the IGP and the Home Ministry. I'm sure the police can tell who were involved by looking at the videoclip. There is no reason why the police can't identify the personnel involved in the alleged assault."

Eleven others are also scheduled to give their statement for the first day of the inquiry and 10 others are expected to be called in on Thursday.

Earlier, Zaitoon stated the panel's three-point terms of reference mainly to:

* Inquire whether or not any law enforcement personnel in performance of their duty to maintain law and order had used excessive force during the incident;

* If there was excessive use of force, whether there was any violation of human rights of any person or persons and, who were the parties responsible for such a violation; and

* Recommend what action be taken against those responsible for the violation of human rights.

Motion on Cheras issue rejected

THE protest over the Bandar Mahkota Cheras road closure, which left several people injured on Tuesday, reached the Dewan via a motion tabled by an Opposition MP who wanted the matter debated. The Chair rejected it.

The drama began when Deputy Speaker Datuk Wan Junaidi Tuanku Jaafar rejected the motion by Teo Nie Ching (DAP – Serdang) to debate the road closure issue.

Wan Junaidi said the motion could not be accepted as the concessionaire was involved in a court case with the housing developer over the same issue.

“Discussing the matter here (in Parliament) will tantamount to sub judice,” he said.

Meanwhile, a representative from the Bandar Mahkota Cheras road opening committee handed a memorandum to Works Minister Datuk Mohd Zin Mohamed, demanding that the Government explain whether the toll concessionaire was allowed to barricade the access road.

MOTORISTS using the Bandar Mahkota Cheras intersection are now all smiles due to the hassle-free drive.

Following Works Minister Datuk Mohd Zin Mohamed's visit to the site on June 4, the Malaysian Highway Authority (LLM) and Cheras-Kajang Highway concessionaire Grand Saga Sdn Bhd were instructed to resurface the road and install more traffic lights.

Traffic still builds up at the intersection bypassing the 11th Mile Cheras toll plaza during peak hours but the flow is smoother now due to the better road condition with six additional traffic lights to synchronise the flow.

Resurfacing was required because the access road built for the Bandar Mahkota Cheras township was damaged by concrete barricades built by Grand Saga. This caused motorists approaching the intersection to slow down but the situation is different now.

The intersection made headlines recently when Bandar Mahkota Cheras residents kept demolishing the barricades built by Grand Saga.

On May 30, the Federal Government intervened by stating that the road should remain open until a court decision on the case between Grand Saga and township developer Narajaya Sdn Bhd.

With the road now declared open for the time being, motorists from the township and neighbouring Bandar Sungai Long are a heaving sigh of relief.

Bandar Mahkota Cheras resident Suraya Haris Ong said the travelling time to work had been cut by 30 minutes.

“I work in Jalan Ampang, Kuala Lumpur, and used to spend time waiting at the T-junction connecting Bandar Mahkota Cheras to Bandar Sungai Long. Then, there is the additional time to get to the highway,” she said.

“I save all this time by simply heading out from my house to the intersection and then getting on to the highway. Coming back is also a breeze although there is traffic during peak hours,” she added.

A motorist, who only identified herself as Ling, said she used to wake up her son at 5.30am just to get him to school in Bandar Tun Hussein on time. She said both of them were now happy because they could spend another 30 minutes in bed.

Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah, when contacted, said residents would be more jubilant if the Government declared the road permanently open.

“If you look at it from all angles, residents should not be the ones caught in the tussle between the developer and highway concessionaire. Basically, it is an issue involving compensation, dollars and sen,” he said.

KAJANG: The controversial Bandar Mahkota Cheras intersection, which led to a Cabinet intervention on May 30, will be upgraded and will remain open to the people.

Works Minister Datuk Mohd Zin Mohamed, said the Malaysian Highway Authority and Cheras-Kajang Highway concessionaire Grand Saga Sdn Bhd had been instructed to begin upgrading works on the road that would by-pass the 11th Mile Cheras toll plaza.

Mohd Zin, who visited the site yesterday, said six more traffic lights would be installed at the intersection below the highway to make things better for road users from the Bandar Mahkota Cheras, Bandar Sungai Long, Bandar Tun Hussein Onn and Cheras Perdana townships. The road will also be resurfaced.

The intersection made headlines in recent days when the public demolished the barricades built by Grand Saga four times this year. Grand Saga had claimed losses due to their by-passing the toll. This led to a series of incidents filled with injuries and arrests.

The Government stepped in, ordering the removal of the last barricade and promised that the road would remain open until the legal dispute between Grand Saga and Bandar Mahkota Cheras developer Narajaya Sdn Bhd is resolved in court.

Chor: Concerted effort needed to curb human trafficking

KUALA LUMPUR: Human trafficking and smuggling is a global problem which can only be tackled through a regional concerted effort, said Deputy Home Minister Datuk Chor Chee Heung.

“The Anti-Trafficking in Persons Act can be effective within our country but human trafficking and smuggling is a regional and worldwide issue,” he said after he officiated the three-day Bali Process: Workshop on People Smuggling - Threat Assessments and Risk Analysis here.

“Information and intelligence sharing is important between the Bali Process member states.”

The Bali Process is a concerted effort among members on practical measures to help combat smuggling and trafficking in persons in the Asia-Pacific region.

Chor said human smuggling involves the cooperation of those affected, but human trafficking is by force.

On the Bandar Mahkota Cheras issue, Chor said he was unfairly criticised for his comment that he had not received reports on excessive force used by the police.

“I never said the police didn’t beat up the young man (Chang Jin Haur, 21). What I said was that I wasn’t there, so what I know is based on the report from the police,” he said.

Chang was hospitalised for injuries to his face and mouth when he and a friend were allegedly beaten up by police and FRU men who claimed that he had tried to run one of them down with his car.

Bail extended for four in Bandar Mahkota case

PETALING JAYA: Police have extended the bail of the four people who are being investigated for allegedly attempting to cause injury to several Federal Reserve Unit (FRU) personnel in Bandar Mahkota Cheras on May 27.

The bail for Chan Siew Meng, 31, Cheok Kem Hoo, 21, and Chang Jiun Mein, 21, has been extended until June 10 while Chang Jiun Haur's bail was extended until June 11.

Kajang OCPD Asst Comm Shakarudding Che Moof, when contacted yesterday, said police have recorded their statements.

He said the investigation paper into the incident would be completed in two days and sent to the Attorney-General’s chambers for action.

Show of strength in unity

I HAVE been following the Bandar Mahkota Cheras access road issue with much interest although I do not live anywhere near Cheras nor do I use the route in question.

What really moves me is that each time there is a report on the issue in the media, I can see images of Malaysians from all races seemingly united and committed to a single cause.

The faces of the residents show such conviction in the cause that I think I can show the pictures to my foreign friends and convince them that Malaysia is indeed of different races that not only live in harmony with each other, but also can work perfectly together without any bias nor prejudice against each other.

It is quite strange that I get this patriotic feeling out of pictures of near-riot incidents. Despite what they say about wide divisions among races, perhaps all is not lost for our beloved Malaysia.

If all races can show this sort of unity in our other daily business, then I have confidence Malaysia will grow further to greater heights.

The Bandar Mahkota Cheras residents have shown us that with unity, much can be achieved. Obstacles such as thugs with sticks are minor sacrifices for a cause they believe in.

I hope we all can take heed from this example. We are stronger united. We can draw from each other's strengths if we are one. And it would be hard for our adversaries to harm us if we are together, however powerful they are.

Suhakam to open inquiry on alleged police violence

KUALA LUMPUR: The Human Rights Commission (Suhakam) will open an inquiry on the alleged violence by the police against four people who were protesting against the building of the barrier at Bandar Mahkota Cheras.

Commissioner Datuk N. Siva Subramaniam said he wanted to know how the Federal Reserve Unit handled the situation on Tuesday night.

“Based on the victims’ accounts and video footage, we do not think that the four people posed any threat to the police,” he said in a press conference at their office here yesterday.

He said Suhakam would be meeting soon with the police to get their side of the story.

At about 11pm on Tuesday, four people in a car were arrested when driving home to Bandar Mahkota Cheras.

The four claimed that the police stopped their car and surrounded it.

They also claimed that the FRU then smashed the car windows. causing them to be injured.

Commissioner Datuk Dr Denison Jayasooria, who was also at the press conference, said he wanted real answers from the police for their actions.

“I feel very sad such an incident took place and on the exercise by the officers in uniform.

“We are finding such harsh behaviour a reflection on the police force.

“Therefore, the Home Affairs Ministry and the police must come out and explain,” he said.

KUALA LUMPUR: The residents of Bandar Mahkota Cheras are happy and relieved that the issue concerning the toll-free access road is settled for now.

However, they wished that it could have been solved much earlier and without the need for the situation to turn tense.

Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah said the Government should not have let the issue drag on for more than two years.

“However, I am glad that it has come to a happy ending and the rakyat is grateful for the Works Minister’s announcement,” he said in reaction to Works Minister Datuk Mohd Zin Mohamed's announcement that the Cabinet had decided that the road into Bandar Cheras Mahkota should not be barricaded.

His friend Pang Nam Onn, 44, said ever since he bought a property in Bandar Mahkota Cheras five-years ago, his main problem had been the morning traffic jams which resulted from the area having more than 20 housing estates.

“Now with the decision to open the access road we will have a choice of two exit points.”

Cabinet orders access road to stay open

Bandar Mahkota Cheras access road to remain open

KUALA LUMPUR: It was victory for the residents of Bandar Mahkota Cheras after the Government ordered the Cheras-Kajang Highway operator to tear down the barrier along the access road to their housing area.

Works Minister Datuk Mohd Zin Mohamed, who made the announcement at the barrier site yesterday, said the Cabinet had decided that the road should remain open at least until a court case between the operator Grand Saga and Mahkota Cheras developer Narajaya Sdn Bhd was settled.

The joyful faces of hundred of residents who had gathered to witness Mohd Zin's visit were a stark contrast to those who were at the same spot several times over the past few weeks to tear down barriers which Grand Saga rebuilt four times.

The last episode was on Tuesday night when several residents were attacked by unidentified people.

“Grand Saga has agreed not to re-erect the barricade and not to engage a third party to take action against the Federal Government for the losses that they had suffered for vehicles using the toll-free access road,” Mohd Zin said yesterday.

He promised that there would be a permanent solution.

“I hope all parties, including the residents, will obey the law as the Government is sensitive to the peoples' needs. We need to work together to solve the matter amicably.”

Mohd Zin said the Government would relook its decision once a court decision was made.

Grand Saga is claiming compensation from Narajaya for loss of income since its toll plaza will be by-passed with the construction of the road.

After Mohd Zin's announcement, Grand Saga workers removed the concrete boulders from the middle of the road under the bypass between the Mahkota Cheras and Bandar Tun Hussein Onn access roads.

When met by reporters later, Taliworks Corporation Bhd chief executive officer Abdul Rahman Siraj said the Cabinet’s decision was fair to the residents, Grand Saga and the other parties concerned.

Taliworks has a 55% stake in Cerah Sama Sdn Bhd which owns and operates the highway via wholly-owned Grand Saga.

“The decision has temporarily solved the matter, and I would like to thank the minister for personally breaking the news,” he said.

Abdul Rahman said he hoped to have talks with Narajaya and hoped the ministry would be able to mediate so that both parties would be able to find an amicable solution before the court decision.

He said for the past few weeks, “unpleasant things” had occurred and he assured the public that Grand Saga was not involved in any of the criminal acts.

“Why should we engage thugs, and aggravate the matter?”

In Shah Alam, Selangor Mentri Besar Tan Sri Khalid Ibrahim said the state would no longer call for an extraordinary general meeting in Grand Saga now that the Works Ministry had resolved the issue.

“I would like to thank the Federal Government and the Works Minister for making the right decision.”

Federal Government should step in to help

I HAVE read with disgust the ongoing situation at the Bandar Mahkota Cheras junction.

In the end, the residents are the ones who suffered.

The deafening silence of the Federal Government's top leadership has added to the frustrations of the people. The court case needs to be speeded up to clear the air of uncertainty.

Now, with the involvement of unknown bullies coupled with angry residents, the situation could turn ugly. It is time the Federal Government stepped in to resolve this issue.

It is not enough to just let the police and FRU handle this as the residents could not get answers from these apolitical institutions and it only adds to their anger and fuels more distrust.

The safety issue being spoken about by Grand Saga is not valid enough as they did not put forth any action plan to settle this.

Ordinary Malaysians like me do not want to see this prolonged anymore.

For the sake of peace and harmony, people who have the power to change should do something fair and fast.

KUALA LUMPUR: Dewan Rakyat Speaker Tan Sri Pandikar Amin Mulia says he will resign when he cannot take it anymore.

"I keep telling myself if I can't take it anymore, handle the challenge or control my temper in Dewan, I will go up to the person who appointed me and tell him that I'm resigning.

"I will tell him that it's affecting my health," he told reporters Thursday after receiving a courtesy call from Iraqi Embassy charge d'affaires Hoshiar Dazay at his office here.

Pandikar Amin said although his health was good and in top condition, his family had a history of heart attacks.

"My cholesterol level is a bit high as well. At the moment, however, this is still under control and I can still tolerate the goings-on in Dewan," he said.

Pandikar Amin said he tried to forecast events in Dewan before the day even began as a way of controlling his temper.

"But sometimes, events get out of hand. Now, my tactic is to switch their microphone off until the MPs have finished shouting at each other," he said.

Since the new Parliament sitting began on April 28, both Pandikar Amin and his deputies had been forced to impose control on a sometimes rowdy House during this meeting, which for the first time, only had a simple majority for the Barisan Nasional government.

Asked if he had enjoyed his post so far, he said that "some people like contact sports like boxing although it hurts.

"I took up this job because I thought I wanted to put into practice all my experience as a politician. I have been a minister, a backbencher and an assembly speaker.

"However, for this Parliament, I will try my best to ensure no MP is ever kicked out," he said, adding that there were however several who were testing his patience.

Too many MPs, he added, were also resorting to the emergency motions under Standing Order 18(1) to ask for a debate on matters relating to individuals, such as that related to a person who was injured during a commotion in Bandar Mahkota Cheras.

"I have not allowed many such motions because it would open the floodgates in the future," he said, adding that many of these were also done for "political mileage". "My opinion is that if the television broadcast is extended to the full sitting, MPs will behave better because they will no longer be too self-conscious," he said.

Pandikar Amin also confessed that the sitting on April 30 was "beyond his imagination" but that since then, he had seen a lot of improvement, particularly among the first-term MPs.

But in the next meeting, scheduled for June 23, he said he would like to see MPs leaving their political agenda behind when entering Dewan.

"This is not unrealistic because this is practised in the English Parliament. It's a place to debate and pass laws," he said.

KUALA LUMPUR: A solution is in sight to the Bandar Mahkota Cheras access road issue.

Works Minister Datuk Mohd Zin Mohamed is expected to visit the site today and make an announcement, according to highway concessionaire Grand Saga Sdn Bhd.

In a statement yesterday, Grand Saga executive director (business development and corporate affairs) Zainal Abidin Ali said they met Mohd Zin yesterday to discuss the issue.

On-site visit: Khalid, accompanied by Selangor reps, being greeted by Bandar Mahkota Cheras residents during a visit to the site yesterday.

“After the meeting, we believe that a solution is in sight. The Minister will issue an official statement tomorrow,” said Zainal Abidin.

Grand Saga has in the past few weeks tried to re-erect a barricade to prevent residents from by-passing the toll booth, claiming that the access road was illegal.

However, a statement from Bandar Mahkota Cheras developer Narajaya Sdn Bhd reiterated that it had been granted approval for the access road.

“We wish to place on record that when we launched the BMC housing project, we were granted approval by the relevant authorities to build an access road connecting to the then Cheras-Kajang Highway.

“That approval was obtained before the Government granted Grand Saga the concession over the highway.

“Therefore, in building the access road to connect to the highway, we were merely fulfilling our obligation as required by the authorities,” the statement said.

Selangor Mentri Besar Tan Sri Khalid Ibrahim, who visited the site yesterday, has asked the parties involved to reach an amicable solution in two weeks.

“I would appreciate if they can put an end to this long-standing fracas,” he said, to applause from residents.

“This has been going on for too long and there must be an amicable solution.

“There is a road, so why close it?” he asked.

Khalid said the problem had to be solved soon or else the state government, as a stakeholder in Grand Saga, could ask for an extraordinary general meeting to discuss the matter.

Every attempt by Grand Saga to block the access road has been thwarted by angry residents, who tore down each new barricade.

One resident, who sustained injuries during a fracas between residents and an unidentified group of people on Tuesday, said he was happy that the issue would soon be resolved.

“However, we are disappointed that it took so long, especially after so many residents were injured (on Tuesday), and two are still recuperating in hospital,” said the man who requested anonymity.

As at 6pm yesterday, the situation at the access road appeared normal although there was a massive traffic jam caused by boulders that had fallen onto the middle of the road under the bypass between the Bandar Mahkota Cheras and Bandar Tun Hussein Onn access roads.

KUALA LUMPUR: Some 30 residents of Bandar Mahkota Cheras brought their case to Parliament, wielding banners urging the Works Minister to reopen the access road to the housing area.

They gathered outside the Parliament building with banners which read: “Menteri Kerja Raya, Tolong Rakyat Buka Jalan” (Works Minister, please help the people open the road).

A resident, who only wanted to be known as Mas, said the barricade, built by highway concessionaire Grand Saga Sdn Bhd, had created serious traffic congestion for the residents in the area.

“I have to leave my house every day at 5.30am to send my children to school. If I leave at 6am, I would not be able to make it,” said the mother of three, who has been living there for five years.

On Tuesday, Mas was at the site to show support to the residents who opposed the rebuilding of the controversial barricade at about 7.30pm.

She said, all hell broke loose when the crowd started smashing cars and throwing stones. She cracked a bone in her arm in the fracas.

DAP adviser Lim Kit Siang, who met the residents outside the Parliament building, asked for an inquiry into the incident in which thugs were allegedly used against residents during the protest.

“There should be a full inquiry into this incident. The residents have a right to object to the building of the barricade, and there should not be any physical violence,” he said.

Deputy Home Minister Datuk Chor Chee Heung, replying to queries by MPs while winding-up the debate on the Supplementary Supply Bill for his ministry, said nine police reports were lodged by the public following Tuesday's incident.

In the confusion, four people in a Proton Wira were detained for allegedly trying to run down police officers.

“There were allegations that the police had used force against the public, but none of the police reports we received were connected to this. I urge those who say they were assaulted by the police to lodge reports so that we can get to the bottom of the matter,” he said.

Chor said the police would not take sides in any situation and assured the House that they were always professional when carrying out their duties.

KUALA LUMPUR: There is no way the police would have watched civilians being beaten up by others without taking action, said Home Minister Datuk Seri Syed Hamid Albar.

He said he needed to know more about what happened during the scuffle between Bandar Mahkota Cheras residents and alleged thugs on Tuesday over the closing of a toll-free road in the housing estate.

“If there is conflict, they (the police) will step in,” he said at the Parliament lobby yesterday.

He was commenting on allegations by residents that the police stood by and watched as alleged thugs began attacking them when they tried to tear down a barricade erected on a toll-free road by the Cheras-Kajang Expressway operator.

“If there are reports that the police did nothing to protect civilians, then of course investigations will be done,” he said.

He said the police statement on the incident was also not given the same weight by the media.

THE Selangor state government wants Bandar Mahkota Cheras developer Narajaya Sdn Bhd and highway concessionaire Grand Saga Sdn Bhd to work out a win-win solution for the benefit of the residents.

Mentri Besar Tan Sri Khalid Ibrahim believes that if the two companies are willing to meet to seek an amendable solution, the Bandar Mahkota Cheras problem can be over even as early as within two weeks.

If the talks failed, the state government, which holds a substantial stake in Grand Saga, plans to call for an extraordinary general meeting (EGM) of the company to discuss the problem.

Khalid visited the scene of the dispute at 1.15pm yesterday, stood on a stone barricade and addressed the crowd.

He told the residents who had gathered there in the hundreds that the two-and-half-year-old saga could be solved within two weeks if the contending firms agreed on an acceptable mutual solution.

“As a stakeholder in Grand Saga, the state government wants to exercise its right to call an EGM if the meeting does not take place between the highway concessionaire and Narajaya to discuss the issue,” he said.

“I hope this would not be necessary if both Narajaya and Grand Saga can settle the problem between them,” Khalid said to applause from the crowd.

He said Grand Saga should not deprive the people from using the road until a solution had been worked out.

“The state government is not pointing fingers at Grand Saga for putting up the barricades. All it is asking for is for the company to cooperate with it in this matter, which otherwise is not helping both parties,” he said.

Khalid said it was not good for Grand Saga and the residents to be involved in constant confrontation over the closing of the access road.

Khalid said that when he met with Narajaya officials, he was told that the access road to the highway was part of the township’s development plan.

Grand Saga has, however, objected to the access road, saying that should the road be allowed, its revenue would be reduced as motorists would be able to bypass the toll.

“This is a business argument but for the sake of the residents, this matter should be resolved immediately. We do not want more people getting hurt if the matter is prolonged,” Khalid said.

State Local Government and Research Committee chairman Ronnie Liu, meanwhile, pointed out that Grand Saga did not have the right to block the access road as the underpass was an old road and was there even before the highway was built.

“The residents are only using a road that was already there. Grand Saga only has jurisdiction over the roads they build,” Liu said.

“If Grand Saga did not have the approval of the Malaysian Highway Authority (MHA) to put up the barricades, blocking the access road is illegal,” he said.

On Wednesday, the residents tore down a barricade built by Grand Saga that prevented access into the housing area of some 40,000 residents.

Some of the large boulders removed were left in the middle of the road leading to Bandar Mahkota Cheras and this has created a massive traffic jam at the underpass of the Cheras-Kajang highway between the Bandar Mahkota Cheras access road and Bandar Tun Hussein Onn access road.

On Tuesday, tensions ran high when hundreds of residents gathered to remove the barricade, which was rebuilt a day earlier to prevent access into the area.

Grand Saga had reconstructed the barricade after the residents took it down a few weeks ago.

KUALA LUMPUR: Residents of Bandar Mahkota Cheras have torn down a barricade rebuilt by Grand Saga Sdn Bhd that prevented access into the housing area of some 38,000 residents.

Using mallets, car jacks and steel bars, the residents broke down the foundations of the barricade made of large boulders and forced the stones to the ground.

The boulders were then chained to lorries and dragged away to the side of the underpass of the Cheras-Kajang Highway, which leads into the neighbourhood.

By 7.15pm, the first vehicle had managed to inch its way through the two-lane access road, amidst the cheers and loud blaring of vehicle horns from onlookers and residents alike.

Police and Light Strike Force personnel monitored the crowds, which swelled to a few hundred.

More roars of support ensued later when Selangor CPO Deputy Comm Datuk Khalid Abu Bakar, who visited the spot, told the residents that he had advised Grand Saga to stop any construction of barricades in the area.

He said the public would be inconvenienced each time Grand Saga built the barricade. DCP Khalid also urged the Malaysian Highway Authority and the Public Works Department to settle the matter and come up with an amicable solution.

He also urged the elected representative not to incite the residents.

Kajang OCPD Asst Comm Shakaruddin Che Mood, who was also present, was hoisted up by several residents who lauded his support for their cause.

He also persuaded residents to remove several toppled boulders that were blocking cars going into the Bandar Tun Hussein Onn access road.

Several residents then pooled together RM900 to get the job done, saying that a third of the sum would be for the lorry’s petrol while the rest would be used to buy food.

Earlier, two photographers from Sin Chew Daily and China Press were attacked by two unidentified men, who had threatened to beat them if they did not stop taking pictures.

By 10pm, all boulders had been cleared.

SHAH ALAM: The state government will exercise its right as a stakeholder in Grand Saga Sdn Bhd to call for an extraordinary general meeting (EGM) soon to discuss the Bandar Mahkota Cheras access road issue.

It has a stake in the highway concessionaire through its subsidiary Kumpulan Perangsang Selangor Bhd, which owns 20% of Taliworks Corp Bhd. The latter holds a 55% stake in Cerah Sama Sdn Bhd that wholly owns Grand Saga.

Mentri Besar Tan Sri Khalid Ibrahim said since the state government held a substantial share in Grand Saga, it wanted to inform shareholders of Grand Saga's actions and to ask them to decide if such actions, which have caused problems for residents, were ethical.

He said the closing of the access road and stand-offs with residents in the area had led to them getting hurt, and the state government wanted to put an end to it.

“We will also ask for an audit of the company’s finances to see if it hired thugs to stop residents from removing the barricades, as claimed by residents.

“If this is true, action will be taken against the company officials involved and its director,” he said after chairing the weekly state executive council meeting here yesterday.

He said he had met, and would write to, Works Minister Datuk Mohd Zin Mohamed for an official decision as to whether the company should be allowed to put up the barricades as highways came under the ministry’s purview.

Khalid said the state government also met senior officials from Taliworks Corp, the Public Works Department and the Kajang Municipal Council (MPKJ) yesterday and had decided to seek Malaysian Highway Authority (LLM)’s clarification as to whether it had given its approval for the barricades, as claimed by Grand Saga.

And, if LLM did not, then the state government would immediately order the removal of the barricades, he added.

“The tussle is between the developer (Narajaya Sdn Bhd) and Grand Saga because the concessionaire wants the developer to pay it for loss of income since its toll will be bypassed,” he said, adding that the matter was already in court.

“There is no need to deprive the people of the use of the road because it will be opened, no matter which way the court decides and the issue is only whether the developer will have to compensate the highway concessionaire.”

Khalid urged residents to be patient while the state government worked out a solution.

Developers must also have social responsibility

I HAVE been following the media reports on the Cheras-Kajang Highway issue involving concessionaire Grand Saga and Bandar Mahkota residents.

According to The Star on May 8, Grand Saga business development and corporate affairs executive director Zainal Abidin Ali said that while he sympathised with the residents for being forced to use a longer route, Grand Saga had to close the access road due to safety concerns.

We urge Grand Saga not to manipulate the word safety as a ticket out of this situation. The developers, as part of their social obligation to road users, must have humanised their design rather than focusing on maximum profit generation.

If safety is of concern, the developers should work together with the residents and other independent parties to study the extent of unsafe factors of the blocked access road and rectify it together with the local government and the Works Ministry.

Some 15 of the 22 highways in the Klang Valley are said to be making profits, as indicated by the Works Minister and this includes Grand Saga. Increasing volume of vehicles, urban migration and land development in areas around the Grand Saga highway will surely ensure profits for the concessionaire for a long time.

The standoff in Bandar Mahkota Cheras is not the first in Malaysia concerning highway construction. If safety was a concern for concessionaires and those offering the concessions, then we would not have highways like the KL-Putrajaya Highway running behind residents’ backyards in Sri Petaling and just few metres away from shop houses in Port Klang.

The residents of Sri Petaling also demonstrated against the highway but failed to do anything and the their house values depreciated.

Cheras is known to be notorious for traffic jams, despite the highways. Most of the highways in Klang Valley have not realised the objectives they were meant for i.e to reduce traffic congestion.

Instead, the unchecked increase in conventional vehicles has resulted in negative social and environmental impacts.

The increased use of conventional fuel-intensive vehicles is perhaps one of the major contributors to green house gasses in Malaysia. During traffic jams, we witness a many-fold increase in travelling time, fuel consumption and emissions.

In the context of the UN guidelines for Consumer Protection and the Rio Declaration, consumers have the right to choose and if consumers choose to practice sustainable consumption, it is the state’s obligation and responsibility to protect and support them.

In the case of Bandar Mahkota Cheras, residents have chosen shorter routes, perhaps saving fuel, time and money. Consumers also have the right to seek redress, a right to a healthy and sustainable environment and the right to be heard.

Inconsiderate and irresponsible land developments indicate a sheer absence of awareness on the seriousness of global warming among policy makers and private companies like the highway concessionaires. It also indicates sheer ignorance towards the environmental and societal needs of the people.

Most construction work of highways, roads and land development along the highways does not effectively engage stakeholders who are directly affected by the development.

Klang, for instance and as reported by the media, has been subjected to unplanned land development resulting in traffic congestion, isolated flooding and, of course, pollution.

We have come across demographic statistics showing the population of Klang reaching 1mil and shopping complexes, housing estates and business centre projects were being approved and former agricultural land being developed for the projects. This kind of irresponsible development does not engage the stakeholders.

Worse still is the plight of residents at Taman Garing, Rawang. Improper maintenance and measures taken to manage flooding and runoffs have caused insurmountable losses to the residents due to mud and flash floods.

We urge that all those involved in the planning of corridors and other forms of land development, from the federal government downwards, have a strong sense of social responsibility in approaching development.

RESIDENTS of Bandar Mahkota Cheras are calling on the Federal Government to intervene to end the access road crisis that has been brewing in their housing estate over the last three months.

“This case has gone national and we have brought it up in parliament three times. Blood has already been shed, what if someone dies because of this?,” questioned resident Eric Lee.

The township hit the news once again on Tuesday when residents clashed with workers hired to re-build a concrete barrier across the access road.

Federal Reserve Unit personnel called in to quell the fracas left the scene at 2am yesterday.

About 200 residents returned to the site to remove the barricade’s concrete blocks. They deliberately placed two blocks in the middle of the road to obstruct traffic from Bandar Tun Hussein Onn heading to Kajang, in order to “let everywhere be congested”. Starting at 8am yesterday, residents took turns to guard the area.

At about 1.30pm, they tried in small groups to remove the barricade and even collected money to hire trucks to do the job. Some RM800 were collected instantly but no truck was seen arriving at the scene.

At 3.30pm, the group tried to remove the blocks again with carjacks. Police helicopters were seen patrolling the area for about five minutes.

At 4pm, they successfully brought down three blocks and continued on.

Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah said as of 11.30pm on Tuesday, 12 injured residents sought treatment at the Kajang Hospital while five others lodged police reports.

He said he was informed that a woman was beaten by a group of eight men, adding that she was in intensive care unit and could not be contacted.

He believed 45% of the people who turned up at the fracas were not Bandar Mahkota Cheras residents, who had been told to leave the matter to the state government, but were nearby residents who championed the same cause.

He urged victims of the fracas to lodge police reports.

“Disappointed, disappointed, very disappointed, that’s all we can say about the whole situation,” he said.

Meanwhile, Grand Saga Sdn Bhd’s business development and corporate affairs executive director Zainal Abidin Ali issued a statement disassociating the company from the altercation between the parties involved.

“Grand Saga wishes to inform that it has also received a report from its contractor that several of its workmen were injured while carrying out their duties. A police report has been lodged.

“Grand Saga was given to understand that the incident was instigated by certain parties. It will be filing a police report and hopes that the police will carry out an investigation immediately,” it read, while extending sympathy to persons who sustained injuries.

In Parliament yesterday, Loong Meng Yee reported Segambut MP Lim Lip Eng denying he had ‘abandoned’ Bandar Mahkota Cheras.

“I was at Parliament on Tuesday and also needed to attend some other pre-arranged functions. The matter should be left to the court as there are three legal actions pending,” said Lim at the Parliament lobby yesterday.

He also stayed away because he had been informed on Tuesday afternoon that there would be “thugs” present that evening.

“I did not want to face thugs although I am willing to face the authorities,” said Lim.

He added that he had warned DAP members in the area and the residents not to take matters into their own hand over Grand Saga’s action to rebuild the barricade.

“The committee also gave their word they would not remove the barricade after it was erected,” said Lim.

THE Selangor government may take legal action against the concessionaire for the Cheras-Kajang Highway for violating an undertaking not to obstruct the access road in Bandar Mahkota Cheras without state approval.

State local government, research and study committee chairman Ronnie Liu said the concessionaire, Grand Saga Sdn Bhd, gave the undertaking in court after Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah sought an injunction to stop the company from closing the access road.

“The injunction by Tan was struck out but the concessionaire gave an undertaking in court that it would not erect a barricade along the stretch of the access road build on state land.

“We (the state government) are upset that the company has now gone against the undertaking by re-erecting the barricade and we are looking into the possibility of filing for contempt of court proceedings,” he said, when contacted yesterday.

He said the state government’s next course of action would be discussed at the state executive council meeting.

Liu however has appealed to Bandar Mahkota Cheras residents to remain calm and not do anything hasty such as attempting to remove the barricade on their own.

“I urge the residents not to take matters into their own hands and let the state and federal governments to resolve the matter,” he said.

Meanwhile Mentri Besar Tan Sri Khalid Ibrahim when met at Parliament yesterday told reporters that he had raised the Bandar Mahkota Cheras barricade issue with Works Minister Datuk Ir. Mohd Zin Mohamed and sought the latter’s assistance to resolve the matter soon.

KUALA LUMPUR: Tensions ran high at Bandar Mahkota, Cheras, when hundreds of residents gathered to remove a barricade which was rebuilt early yesterday to prevent access into the area.

Four people were arrested in the incident.

Grand Saga Sdn Bhd, the concessionaire of the Cheras-Kajang Highway, had reconstructed the barricade after it was taken down by the residents a few weeks ago.

A fracas ensued at about 7.15pm when a group of unidentified men armed with sticks and helmets attacked the residents. Several residents were taken to hospital.

Also injured was a photographer from Utusan Malaysia, Roy Azis Abdul Aziz, who was beaten up when he tried to snap some photographs.

Several cars parked at the roadside were also smashed by the group.

The group of men sat on the blocks, not allowing the residents to remove them and threatened to attack those who tried to go near the barricade. However, the group disappeared when the police arrived later.

On May 8, about 1,000 residents from the nearby areas demonstrated at Bandar Mahkota Cheras.

Kajang OCPD Asst Comm Shakaruddin Che Mood said Grand Saga Business Development and Corporate Affairs executive director Zainal Abidin Ali had written to him on Monday informing that they would rebuild the barricade, and requested for security.

However, ACP Shakaruddin rejected the request as there was no court order on the matter.

Grand saga contractors started to rebuild the barricade at 12.30am and finished at about 6pm. Zainal Abidin said the barricade was built on an “indisputable area” within Grand Saga’s boundaries.

Until last night, five of the injured had lodged reports at the Kajang police headquarters.

One of the victims, who only wanted to be known as Ina, said she and her husband with their four-year-old son were watching the drama when a group of men suddenly attacked them.

A resident, who only wanted to be known as Ken, said he was hit by a helmet and a pipe on his neck and back.

“I was only watching them pairing down the concrete sledge when suddenly a bunch of people arrived and started beating everyone up. I ran after I was beaten several times but some others were injured quite badly,” said the 28-year-old.

Another resident Kenny Ki, 45, said a group of men came in two cars and five motorbikes.

The residents disperse at 7.45pm but gathered again later to remove the barricades.

At 10pm, the Federal Reserve Unit arrived in three trucks and two water canon trucks and gave three warnings to the residents to disperse.

At press time, only a handful of people were still gathering a distance away from the barricade and several policemen remained.

Saga continues as barricades rebuilt

AN unfamiliar group turned up as “observers” as workers from Grand Saga Sdn Bhd, the concessionaire of the Cheras-Kajang highway, reconstructed the barrier at the access road in Bandar Mahkota Cheras yesterday.

Residents who were monitoring the work done by the workers said they were surprised by the presence of this third group.

The group comprising about 20 male individuals left at about noon and appeared again an hour later when the cement was being laid.

Some of the residents who were at the scene claimed the third group were likely “thugs” hired to deal with residents who might stop the workers from doing their job.

The reconstruction of the barrier began as early as 2am with workers assembling concrete boulders to block the access road.

Raymond Yap, 54, a resident Bandar Mahkota said that reconstructing the barricade was not a wise move .

“We would still have to pay toll because many people here need to use the highway.

“There are at least 30,000 people living here and so you can imagine the volume of cars going in and out. We have to drive about 10km via Bandar Sg Long road, which is a waste of fuel.

“I do not understand how is it that they can block the road which is on state government’s land,” he said, urging the state government to help resolve this problem as soon as possible.

National MCA Youth committee member Loh Chew June hopes that a mutual agreement can be achieved for the sake of the long-suffering residents.

“The state and Federal governments should put their political differences aside and see the problem from the residents’ point of view,” said Loh, who also urged the residents to be calm in dealing with the situation and avoid confrontation.

According to a Grand Saga spokesperson, the company was not aware of any group that was monitoring the reconstruction of the barrier.

Grand Saga to rebuild barricade

GRAND Saga Sdn Bhd, the concessionaire of the Cheras- Kajang Highway, will reconstruct a barricade at the access road in Bandar Mahkota Cheras.

Its executive director, Zainal Abidin Ali, said in a press statement that the barricade was necessary to protect its interest as well as to ensure the safety of highway users.

According to Zainal Abidin, the original barricade was built to prevent unlawful access to the Cheras-Kajang Highway.

It was illegally demolished on April 21.

Since then, a series of events have occurred which led to further proceedings being instituted in the High Court by a resident of Bandar Mahkota Cheras, including an application to restrain the company from re-erecting a barricade.

This was refused by the High Court while noting an undertaking on the part of Grand Saga to re-erect the barricade within its indisputable concession area.

On May 13, Selangor Mentri Besar Tan Sri Khalid Ibrahim had given Grand Saga, developer Narajaya Sdn Bhd and the Malaysian Highway Authority seven days to reach an amicable solution.

The issue was not resolved after the grace period.

Grand Saga had advised the public to respect the court decision.

SELANGOR Mentri Besar Tan Sri Khalid Ibrahim has assured the 38,000 residents of Bandar Mahkota Cheras that the government is with them in their struggle to resolve their access route issue.

The residents are caught in the middle of a right-of-way tussle between Cheras-Kajang Expressway concessionaire Grand Saga Sdn Bhd and Bandar Makhota Cheras (BMC) developer Narajaya Sdn Bhd.

Recently, the long-suffering residents dismantled the barricades erected by Grand Saga barring them use of a shorter and toll-free route into their housing area.

Khalid said the matter was between two business entities and it was up to them to iron out the issue.

“As a developer Narajaya believes it has the right to the land while Grand Saga differs in this view and that is why it resorted to closing the road,” he pointed out.

“Both firms can battle it out in court. If Grand Saga is not successful, the road will be open, and if Narajaya fails in court, the road will also be open, but it would have to pay compensation to Grand Saga.

“The tussle between the two firms will go on until the matter is settled, but in the end the residents will get to use the road,” he added.

Khalid, reiterating that the state understood the residents' plight and would be with them until the issue was resolved, said he had not received any information from Grand Saga, Narajaya or the Works Ministry on their efforts to resolve the issue.

SHAH ALAM: The Cheras-Kajang Expressway concessionaire Grand Saga Sdn Bhd, Bandar Mahkota Cheras (BMC) developer Narajaya Sdn Bhd and the Malaysian Highway Authority have a week to resolve the ongoing tussle over the access route to the township.

Mentri Besar Tan Sri Khalid Ibrahim has given the three parties a week to come up with a solution.

The ultimatum was issued after the state government, Grand Saga, Narajaya and the Highway Authority met for more than an hour at Khalid’s office here on Tuesday.

Khalid’s political secretary Nik Nazmi Nik Ahmad said Khalid had urged the three parties to be calm and not to resort to any drastic action until they came up with a solution.

“The three parties and Tan Sri Khalid will meet again after a week before a final decision is taken,” he said.

Nik Nazmi said Khalid would announce the state’s stand on the issue if no solution was found.

The issue became heated after the residents demolished a barricade erected by Grand Saga to bar residents from having free access to Bandar Mahkota.

As the barricade was built on state land, the Selangor Government fully backed the residents on the matter.

PETALING JAYA: Selangor CPO Deputy Comm Datuk Khalid Abu Bakar said he will not apologise to Segambut MP Lim Lip Eng who was allegedly assaulted by police during a recent demonstration.

He said there was no reason for him to bow to Lim's demands as the MP had flouted the law with several Bandar Mahkota Cheras residents during the Grand Saga demonstration on May 8. It was held over the closure of an access road that bypassed the toll plaza.

“Why must I apologise to a law breaker. I am just doing my job,'' he told reporters after giving away prizes for the best police station in the state at the Kajang station yesterday.

DCP Khalid also held a dialogue session with representatives from the Malaysian Crime Prevention Foundation (MCPF) at the same venue.

Lim had claimed that several residents were brutally treated when they were arrested for protesting. He said he planned to sue the police over the incident unless DCP Khalid apologised.

Lim also claimed that some plainclothes policemen assaulted him when he tried to prevent the Federal Reserve Unit (FRU) personnel from using water cannon to disperse the crowd.

Four people were picked up after about 1,000 people, mostly residents from the nearby areas, gathered from 4pm to stop Grand Saga from building barricades across the road.

The protesters played a cat-and-mouse game with the authorities until 10.30pm when the situation worsened.

Lim pulled the plug of a generator before standing in front of a water cannon to prevent the police from aiming it at the crowd. During the ensuing commotion, Lim was said to have been assaulted.

NUMEROUS calls were made to Segambut MP Lim Lip Eng, says Kajang OCPD Asst Comm Shakaruddin Che Mood.

Lim, who believes his car was damaged during the Bandar Mahkota, Cheras incident, said that the police had failed to send an investigation officer (IO) to look at his car.

Shakaruddin, however, insists that they had tried to get in touch with Lim but failed.

“We do not know why he is not answering our calls. We have been trying to contact him since the day he lodged the police report, which was referred to the Batu 19 police station.

“I had even asked the IO to see him at Selayang Hospital but he was already gone, so it is not right to say that we have not followed the case through.

“We do not want to create any contention with anyone. He can bring the car over and we will do a thorough investigation,” he said.

He added that the police wanted to investigate the matter as soon as possible.

SEGAMBUT MP Lim Lip Eng is still waiting for an investigating officer (IO) from the police station to look at his car, which is believed to have been damaged during the recent Bandar Mahkota, Cheras protest incident.

Lim’s car, a light green-metallic Proton Perdana, which is parked at a mechanic shop on Jalan Ipoh, Kuala Lumpur has visible scratch marks, flat tyres and missing number plate and Ahli Parlimen (MP) crest.

“I had purposely parked my car between two Federal Reserve Unit (FRU) trucks. The police and FRU cannot say they did not know I was an MP because my car had the MP crest.

“I lodged a report at a pondok police near the Hospital Selayang at 6.20pm that day and an officer there took my statement. He said that they would send an IO from Kajang to see my car. It is Monday now.

“I have not repaired my car because I want them to take pictures and investigate. The damages could easily cost RM10,000.

During the Bandar Mahkota saga, Lim also sustained injuries.

“When I got down, the first thing I did was to ask who the officer in charge was but no one said anything, including the workers working on the barriers.

“I identified myself and had to take charge of the situation.

“People can say that the area is not under my jurisdiction but I have been the legal adviser for the Bandar Mahkota Cheras Open Access Road Committee, how can I abandon them in their time of need.

“As I stood there while the police and FRU were warning the crowd to disperse, a plainclothes officer grabbed me from behind. I kept asking who these people were but no one answered me.

“Then some burning liquid was sprayed on my face, which temporarily blinded me. I then felt punches and kicks all over my body and even on my head.

“They only stopped when state executive councillor Ean Yong Hean Wah came to my aid. They did not dare touch Yong.

“I will pursue this matter in Parliament and I want them to apologise to me and to the people.

Lim added that he would not hesitate to sue the police if they did not respond accordingly.

About 1,000 residents from the nearby areas, gathered from 4pm on May 8 to stop the work conducted by workers at the Taman Mahkota junction.

More than 100 policemen, including personnel from the Light Strike Force and the Federal Reserve Unit, were dispatched to the area on Thursday when the residents held a demonstration to protest against Grand Saga.

PETALING JAYA: Cheras-Kajang Highway concessionaire Grand Saga Sdn Bhd will resume the construction of a barricade in Bandar Mahkota Cheras as the court had refused to grant an injunction sought by a resident.

The resident Tan Boon Wah sought the injunction order to stop Grand Saga from barring them from using an alternative access road that allowed them a shorter and toll-free route into their housing areas.

The company’s Business Development and Corporate Affairs executive director Zainal Abidin Ali said that construction would resume on the indisputable portion of the concession area.

“We refer to the media reports on Sunday whereby it was reported that the Selangor State Councillor Ronnie Liu had stated that a survey report from the Survey and Mapping Department had concluded that the land on which the previously demolished barricade was on state land.

“We have not been given a copy of the findings before the court hearing, but from the map attached to the said report distributed to the press, we contend that the map is incomplete,” he said in a press statement yesterday.

He explained that this was because there was “no coordinates to ascertain the alleged location of the previously demolished barricade, and as such, Grand Saga disputes the survey findings”.

The company also emphasised that the more important issue was about the rights of access and not the barricade.

“We trust that there will be no further confusion as to the rights it has over the concession area.

“Nor can Ronnie Liu on behalf of the state government allow or encourage access into the concession area,” he said.

Zin: Government can act only after Narajaya suit is resolved

THE Federal Government has to wait for a court decision on a lawsuit filed by developer Narajaya Sdn Bhd against Cheras-Kajang Highway concessionaire Grand Saga and the Malaysian Highway Authority (LLM) in 2007 before negotiations could resume on the use of the access road.

Works Minister Datuk Mohd Zin Mohamed said no action could be taken by the federal government for fear of subjudice.

“The Government has held a series of meetings between Bandar Mahkota Cheras residents and the concessionaire to resolve the matter over the access road.

“Under the terms of the agreement signed between the federal government and the concessionaire in 1995, any financial loss due to the leakage of traffic volume from the toll highway will have to be borne by us,” he told Cheras MP Tan Kok Wai during a question and answer session in Parliament yesterday.

Zin said the Government was sympathetic to the plight of around 37,000 residents in Bandar Mahkota, who had dismantled the barricades installed by Grand Saga barring them use of a road allowing them a shorter and toll-free route into their housing areas.

“We understand why the residents have resorted to such drastic action. The main toll road is also highly congested due to the high traffic volume of lorries and cars,” he said.

The standoff had turned ugly on Thursday night when police used tear gas and water cannons to disperse a crowd comprising residents who were trying to dismantle the latest barricade put up by Grand Saga.

To a supplementary question by Tan, Zin said although the Survey and Mapping Department report showed that the land the barricade was on belonged to the Selangor state government, there was still the question of who would bear the financial loss incurred by Grand Saga.

Rep: Grand Saga has no right to barricade access street

KAJANG: The Cheras-Kajang Expressway operator has no right to barricade the road into Bandar Mahkota Cheras because a survey has found that it is located on state land.

Selangor executive councillor Ronnie Liu said a Survey and Mapping Department report had shown that the land on which Grand Saga Sdn Bhd had earlier erected a barrier to stop residents from using a toll-free road was state land.

The report and a map have been forwarded to state legal officer Datuk Zauyah Lothy Khan.

“Even before the survey, the state government had ample proof that the road was on state land.

“And until today, the highway concessionaire has yet to show documents to stake its claims,” he said at a press conference at the site yesterday.

The residents of Bandar Mahkota Cheras have been engaged in a battle with Grand Saga since 2005 over the use of a road which allows them a shorter and toll-free route into their housing area.

Grand Saga had earlier built barricades across the road but residents had dismantled the barriers.

The battle turned ugly on Thursday night when police used tear gas and water cannons to disperse crowds of residents who were trying to dismantle the latest barricade.

Liu said Grand Saga should just let the matter rest if it could not dispute the state government’s claim over who controlled the land. It should also not stop the residents from using the toll-free access road.

Liu said he would discuss with the Public Works Department to see if another access road running parallel to the highway belonged to the state to avoid another land controversy.

Grand Saga has applied for an injunction against Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah, Liu and the Kajang Municipal Council to stop them from entering the expressway area.

Tan confirmed that he was served with an ex-parte injunction on Friday night.

Segambut MP Lim Lip Eng, who claimed he was injured during Thursday night’s commotion, said he admitted himself into the emergency ward of Selayang Hospital on Friday afternoon as he was in pain.

Relating Thursday’s events, Lim said: “A plainclothes officer grabbed me from behind and some burning hot liquid was blasted into my face, which temporarily blinded me. I then felt punches and kicks all over,” he said.

He said his car was damaged – tyres punctured, wipers ripped off, surface scratched and a number plate broken.

September 15, 2005: The RM16mil Bandar Mahkota Cheras road is opened by developer Narajaya Sdn Bhd with the consent of the Kajang Municipal Council. A few days later, Cheras-Kajang Highway concessionaire Grand Saga closes the road.

October 2005: Grand Saga business development and corporate affairs executive director Zainal Abidin Ali informs council that the closure is due to compensation issues with Narajaya and says the road would only be opened with a directive from the Malaysian Highway Authority (LLM).

SELANGOR Mentri Besar Tan Sri Khalid Ibrahim said the state government will be holding a meeting with Cheras-Kajang Highway concessionaire Grand Saga Sdn Bhd and the Federal Government next week.

He said the meeting was to find a solution for the tussle between the concessionaire and Bandar Mahkota Cheras residents over the barricade erected by the former on the toll-free access road belonging to the Selangor government.

“We understand the problem as well as the plight of the people and will seek a quick solution,’’ said Khalid when met by Bandar Mahkota Cheras residents at the state secretariat building yesterday.

He said the residents had the right to use the access road without having to pay toll but added that the problem could only be settled when all relevant parties had discussed the matter.

The residents arrived at the secretariat building yesterday at about 11am in a chartered bus and five cars to hand over a memorandum to Khalid. It was received by the his special duties assistant Mohd Yahya Sahri.

The crowd was also met by state executive councillors Ronnie Liu and Ean Yong Hean Wah.

Liu, who met reporters after speaking to the residents, said the concessionaire did not have the right to barricade the access road as it belonged to the state government.

He lambasted the police for taking sides and said that the police should maintain law and order instead of manhandling the residents on behalf of the concessionaire.

Under control: Bandar Mahkota Cheras residents watching the site in case Grand Saga blocks the road again.

“We have all the proof to show that the land belongs to the state government and we have informed the police about this but the police, which is under the control of the Federal Government, is not paying heed,’’ said Liu.

He added that he had spoken to the Selangor CPO Deputy Comm Datuk Khalid Abu Bakar over the phone but the latter had remained stubborn.

Police personnel fired water cannons several times to ward off the protestors who were riding motorcycles and speeding towards the police barricades.

Segambut MP Lim Lip Eng was allegedly assaulted when he pulled the plug of a generator before standing in front of a water cannon to prevent the police from aiming it at the crowd. He is presently recovering at the Selayang Hospital.

“The police must be neutral and not help Grand Saga Sdn Bhd put up the barricade. Since when did the police force go into construction?’’ asked Liu.

He said that he would be speaking to Khalid as well as state legal adviser Datin Paduka Zauyah Be T. Loth Khan to see what action could be taken against the concessionaire.

Liu said the residents also had the right to seek an injunction against the concessionaire as well as seek damages from it through legal recourse.

Bandar Mahkota Cheras residents had been maintaining a 24-hour vigil at the crossroads where the concrete barricade put up by Grand Saga was first dismantled on April 21.

But the tents and garden chairs which residents used while keeping an eye on the road were no longer there on Friday morning. Also missing were self-appointed traffic marshalls who helped to ensure the traffic situation was under control since the traffic lights were not synchronised.

Although small groups of residents were present at the site, the crowd was not as big as the 1,000-odd people who converged on Thursday night where four people including the Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah were arrested.

To-date, Grand Saga has re-built the barricade twice and on both occasions, residents had broken down the barrier.

“They can keep building the barricade but we will keep destroying it,” said Tan when contacted.

He was released from police custody after a few hours.

With the highway concessionaire and the Selangor state government claiming right of way, the issue is still far from being settled.

One resident, Suraya Haris Ong, said authorities should also view the socio-economic impact on the township with low rentals and vacant shoplots since the barricade was put up in 2005.

He said there were more than 100 policemen including personnel from the Light Strike Force and the Federal Reserve Unit at the scene.

BANDAR Mahkota Cheras residents have been advised to apply for an injunction against Cheras-Kajang Highway concessionaire Grand Saga Sdn Bhd for erecting another barricade on the toll-free access road belonging to the Selangor Government.

The advice came from state executive councillor Ronnie Liu in light of the events that unfolded on Wednesday night when Grand Saga installed a new barricade on the road under the watchful eyes of Federal Reserve Unit personnel.

Once again, Bandar Mahkota Cheras residents dismantled the barricade denying them access to the highway. Three people were arrested during the fracas that ensued.

Liu maintained that Grand Saga had committed a serious offence by erecting the barricade. “No party has the right to erect the barricade without the state government's approval and we received no such application,” he said.

The earlier barricade installed in 2006 was demolished on April 21 by residents led by the Bandar Mahkota Cheras Open Access Road Committee. The road has been a major subject of controversy since the right of way is yet to be clearly determined.

Liu said although the Survey and Mapping Department had yet to release its report, the state government had ample proof that the road was on state land.

“We have been informed that the department which is under the control of the Federal Government is not being cooperative because the report should be ready by now. I have asked Kajang Municipal council president Datuk Hasan Nawawi Abdul Rahman to pursue the matter,” he added.

Liu also told residents to seek legal redress for the various grievances they have suffered during the closure of the road.

Tensions ran high when the residents had a stand off with Federal Reserve Unit personnel, who were on standby.

The standoff also caused a traffic jam along the highway in the evening.

The Selangor Government is still waiting for a report from the State Survey and Mapping Department to determine the question of right of way.

Grand Saga business development and corporate affairs executive director Zainal Abidin Ali, who was at the site, said while he sympathised with the residents for being forced to use a longer route, a new barrier would be erected as the concessionaire was concerned about safety issues.

He said the road was now the subject matter of a lawsuit filed against Grand Saga by township developer Narajaya Sdn Bhd.

KAJANG: The Cheras-Kajang Highway concessionaire, Grand Saga, is claiming that the removal of the concrete barricade by angry Bandar Mahkota Cheras residents 10 days ago has caused havoc to the traffic situation in the area.

In a statement faxed to the media yesterday, Grand Saga said the situation endangered road users coming from Bandar Mahkota Cheras and other road users converging into the interchange from the surrounding townships.

Grand Saga business development and corporate affairs executive director Zainal Abidin Ali said the junction that was “forcibly opened” did not conform to safety requirements such as traffic lights and safety signs.

The company is calling for the barricade to be put up again until a solution was found.

The barricade was demolished by the residents to allow them toll-free access to the highway.

“Grand Saga's contract is with the Federal Government hence it was awaiting the directive and guidance from the Government on the issue,” he said.

Zainal said the right of way issue is the subject matter of a legal suit between township developer Narajaya Sdn Bhd, the Malaysian Highway Authority (MHA) and Grand Saga, pending determination by the High Court.

In another development, Selangor executive councillor Ronnie Liu took the State Survey and Mapping Department to task yesterday for being unable to determine who had the right of way in the issue.

He said he was disappointed with the department for failing to provide the surveyors' report as promised because everything hinged on it. The state government had instructed two surveyors to conduct the study.

KAJANG: The Bandar Mahkota Cheras Open Access Road Committee is confident the outcome of today's meeting at the Kajang Municipal Council (MPKj) will be in its favour.

At a press conference yesterday, independent surveyor Khoo Leong Hok pointed out that the barricade demolished on April 21 was erected outside the Malaysian Highway Authority road reserve. Khoo had volunteered his services to the committee.

Seri Kembangan assemblyman Ean Yong Hian Wah produced a letter from the Hulu Langat Land Office that stated the land originally belonged to Bandar Mahkota Cheras developer Narajaya Sdn Bhd because it was obtained through land acquisition as detailed in the Government Circular No 1007, dated May 27, 2003. The road was subsequently delivered to the council.

Last week, Selangor State Local Government, Study and Research Committee chairman Ronnie Liu gave the surveyor on the council's panel another week to present a report on who had the right of way, Bandar Mahkota Cheras or Cheras-Kajang highway concessionaire Grand Saga Sdn Bhd. Another surveyor was appointed by the panel to provide a fair perspective on the matter.

The toll-free access road has been the subject of controversy between both parties since Grand Saga closed the road in 2005.

THE Selangor Government will not pay any compensation to highway concessionaire Grand Saga Sdn Bhd.

State Local Government committee chairman Ronnie Liu said the state government had no contract with Grand Saga, the concessionaire for the Cheras-Kajang Highway in Cheras.

Under the circumstance, he said the state government had the right to open the access road in Bandar Mahkota Cheras so that the residents would be provided with the option of a toll-free access to the area.

“It is absurd to pay compensation totalling RM200mil to the concessionaire when there is no contract.

“The contract is between Grand Saga and the Federal Government and therefore there is no reason why we cannot provide an access road on our land,'' he told StarMetro.

He stressed that the state was determined to open the access road, adding that the Selangor government was firm in its decision on the matter.

“We are the people's government and our stand will favour the people and there is no way things will change on our side,'' he said

Besides that, Liu said the highway builder, Narajaya Sbd Bhd, had not obtained approval for the construction of the highway from the Kajang Municipal Council.

He said they had in fact failed to get the nod from the Malaysian Highway Authority before the highway was constructed.

“To make matters worse, the developer did not submit an application to the council for the construction of the highway,'' he said

He added that after detailed research, he found former Mentri Besar Datuk Seri Dr Mohamad Khir Toyo's claim that the concessionaire must be compensated RM200mil if the access is to be opened as baseless.

THE Selangor government will have to ensure that highway concessionaire Grand Saga Sdn Bhd is paid RM200mil in compensation if it allows the access road in Bandar Mahkota Cheras, Kajang to be opened.

Former Mentri Besar Datuk Seri Dr Mohamad Khir Toyo said when the road was first opened in 2005 the concessionaire had asked for RM200mil in compensation for loss of toll collection based on the formula in the concession agreement.

“That is why we decided that the toll-free access road should be closed as it would be unfair to use taxpayers money to pay such a huge sum,” he said at a press conference.

He said the state had asked the developer, Narajaya Sdn Bhd to pay the sum but the company too found the figure too high.

The current state government, he said, had however promised to open the access road recently but it should not use public funds as it was unfair to the rest of the taxpayers in the state who would not benefit from it.

Dr Khir, who is also the Opposition Leader, also called on the state government to ensure that it kept its promise to offer the first 20 cubic metre of water free to consumers by June 1.

He said the offer would cost water distribution concessionaire Syarikat Bekalan Air Selangor (Syabas) RM17mil a month.

“We do not want to see problems in the implementation as people are eagerly waiting for the free water that was listed as part of their (Pakatan Rakyat’s) election promises,” he said, adding that changes also needed to be made to the billing system.

He said the state government had initially said it would provide free water by April but then postponed it to June 1.

Dr Khir also asked the state government to deliver on its promise during the General Election to give the people a 20% discount on assessment charges on homes and 10% for commercial properties.

He said annual assessment collection in the state stood at RM889mil and providing the discounts would reduce the government’s revenue by RM170mil per year but the pledge to lessen the people’s burden with the discount should be kept by the current government.

“I have also had many come up to my service centre to enquire where and how to apply for the RM1,000 aid that they (Pakatan Rakyat) promised to give each Selangor born university student during the election campaign,” he said.

He said the new intake for students at local universities was in July and people wanted to know the procedures involved in getting the aid.

On the integrated high-tech pig-rearing farm in Ladang Tumbuk, Dr Khir said, the state government should hold a public hearing to get the opinions of nearby villagers and pig rearers before carrying out the project.

He said the Barisan Nasional assemblymen would lend its support too if the government got at least two-thirds of the people and farmers to agree.

“Although it was proposed during our time, it is being implemented under the Pakatan Rakyat government and they need to convince the people it is for in their own good before they go on,” he said.

He said Barisan assemblymen would conduct a public hearing on the matter if the state government failed.

IN a new development to the Bandar Mahkota Cheras access road issue, Cheras-Kajang Highway concessionaire Grand Saga Sdn Bhd has issued a warning letter to the company that owns the heavy machinery used in dismantling the barricade.

Residents of the township brought down the barricade blocking their toll-free access to the highway on Monday after mounting frustration against Grand Saga for closing the road in 2005.

24-hour vigil: Bandar Mahkota Cheras residents have erected tents for the around-the-clock watch at the toll-free access road to prevent Grand Saga from blocking it again.

The highway concessionaire issued the letter to Wing Sing Tractor Work through a legal firm based in Kuala Lumpur.

Among the contents was this phrase, “Take notice that you are to cease and desist from further causing and/or assisting in the damage and/or demolishing of the said barricade lawfully constructed/erected by our client”.

At a press conference on Thursday, Segambut MP Lim Lip Eng who is one of the legal advisers for the Bandar Mahkota Cheras Open Access Road Committee said the letter would be ignored.

Another legal adviser Keppy Wong said no party could claim the legal right to erect the barricade and in doing so Grand Saga had overlooked the lawsuit filed by township developer Narajaya Sdn Bhd and scheduled for a court hearing on May 21.

Cheras MP Tan Kok Wai who chaired the press conference called on the intervention of the Federal Government because the Selangor state government had repeatedly stated its stand on the issue.

“We hope the government would review all highway concession agreements. The Cheras-Kajang Highway was built at a cost of RM286mil but toll collection to-date has exceeded RM300mil. The concession agreement is till 2027 so imagine the profits,” he said.

Residents have been maintaining a 24-hour vigil at the Bandar Mahkota Cheras-Bandar Tun Hussein Onn junction since Monday, fearing the road would be blocked again.

They also take turns to control the traffic flow.

In a special meeting held at Menara MPKj on Wednesday, the surveyor hired by the Kajang Munici-pal Council to determine who has right of way over the road and to clarify ownership of the land asked for more time to announce his findings.

“We are confident the land belongs to the state. But if the outcome proves that the land belongs to Federal government, we hope residents' civil rights would be considered and the matter put to rest with a positive outcome,” said Selangor executive councillor Ronnie Liu who chaired the meeting.

Another surveyor will also be appointed and the results of the report would be revealed on Apr 30.

MORE drama unfolded at Bandar Mahkota Cheras yesterday when the Kajang police temporarily closed the controversial road offering toll-free access to the Cheras-Kajang Highway.

Several patrol cars were used to block the road under the flyover leading to the Cheras 11th Mile toll plaza from 8am to 9.50am. This led to a large group of angry residents gathering at the site to protest the move.

No through road: Police officers were at the junction at 8am to close the road.

Cheras MP Tan Kok Wai, who arrived at the scene at 9am, called Kajang OCPD Asst Comm Shakaruddin Che Mood to seek an explanation.

“I have spoken to the OCPD and he said it was done to protect road users’ safety as the traffic lights at the junction have not been synchronised.

“The police fear accidents may occur,” Tan said.

He appealed to ACP Shakaruddin to allow residents to use the road for another day, pending the outcome of the survey to determine who has the right of way over the road at a meeting at Menara MPKj in Kajang at 3pm.

Police personnel later removed their vehicles to allow motorists to pass through.

The access road built by Bandar Mahkota Cheras developer Narajaya Sdn Bhd was opened in September 2005 and closed soon after by highway concessionaire Grand Saga Sdn Bhd, who cited a loss of toll collection as the reason for the closure.

The government had wanted a survey to be carried out with reports from the Hulu Langat Land Office, Kajang Municipal Council, Narajaya and Grand Saga.

A REPRESENTATIVE from Grand Saga Sdn Bhd, the concessionaire for the Cheras-Kajang Highway, was pelted with stones yesterday when he threatened to restore the dismantled barricade at the Bandar Mahkota Cheras toll-free access road.

Before the incident, Grand Saga representative Zainal Abidin was heard telling residents gathered at the Bandar Mahkota Cheras-Bandar Tun Hussein Onn junction that they had no right to open the road. He roused their anger further by threatening to block the road.

Bandar Mahkota Cheras residents forcefully dismantled the barricade on Monday. They acted on their own accord after learning that the Selangor Government wanted them to wait till today for the surveyor's report which would reveal if the land belonged to the state or the federal government.

The road was barricaded by Grand Saga in September 2005, soon after its opening.

Residents, however, have claimed that the road was included in the Kajang masterplan while the highway was built later and therefore the concessionaire had no right to deny them access.

Serdang MP Teo Nie Ching, who arrived at noon to ease the tense situation between the residents and Zainal, urged Grand Saga to wait for 24 hours more before putting up the barricade again.

“Please maintain your cool till the outcome is known tomorrow (to-day) after 3pm. We are also awaiting the surveyor's report to determine who has the right of way,” she said.

When the StarMetro visited the site in the morning, many motorists were seen using the road although it needed proper resurfacing work.

But traffic at the crossroads leading to the highway and the Cheras Perdana-Bandar Tun Hussein Onn junction was chaotic because the traffic lights were not synchronised.

Traffic police from Kajang later arrived to ensure the traffic flowed smoothly.

When asked what they would do if the road was barricaded again, the residents said the federal government should step in to resolve the matter.

They said the closure affected their rights as citizens and the government should defend their cause.

Angry residents remove barrier at access road

JOY turned to despair and anger when Bandar Mahkota Cheras residents learnt that the toll-free access road to the Cheras-Kajang Highway would not be opened yesterday as earlier anticipated.

More than 700 angry residents who had gathered at the barricade under the flyover before the Cheras 11th mile toll plaza and at the junction to Bandar Tun Hussein Onn took matters into their own hands by forcefully removing the blockage.

With the use of heavy machinery, they removed the barrier placed by highway concessionaire Grand Saga Sdn Bhd in 2006 and defied an order from the Selangor state government to wait till Wednesday.

An excited crowd lead by Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah had earlier gathered at the location yesterday, expecting the Kajang Municipal Council (MPKj) to remove the barrier at 10am.

This came about because on Friday, Selangor State Local Government, Study and Research Committee chairman Ronnie Liu had said that the land belonged to the state and gave the council the power to act.

At 10.20am, heavy machinery brought in by the Bandar Mahkota Cheras Open Access Road Committee with the help of developer Narajaya Sdn Bhd which built the road, began drilling holes into the concrete barriers, amidst cheers from the residents.

Elected representatives who addressed the jubilant crowd in the morning were Hulu Langat MP Che Rosli Che Mat of PAS, Serdang MP Teo Nie Ching and Segambut MP Lim Lip Eng, both of the DAP.

Work was stopped at 10.40am when MPKj president Datuk Hasan Nawawi Abdul Rahman arrived to announce the bad news that the wait would be prolonged.

“The council has received orders from the state government to appoint a surveyor to determine who has right of way over the road.

“The surveyor will collect reports from the Malaysian Highway Authority, Narajaya and Grand Saga and deliver his findings on Wednesday,” Hasan told the crowd who booed and jeered at him.

Calls were then made to the state government to ascertain if this was true.

The elected representatives then left for Menara MPKj to view the letter purportedly from Selangor Mentri Besar Tan Sri Khalid Ibrahim, asking for all work to stop and for the crowd to disperse peacefully.

“We were told to wait but the federal and state governments must understand that we cannot wait any longer. Who is Grand Saga to flex its muscles so that we residents have to live with traffic jams every single day?” Tan asked.

Bandar Mahkota Cheras residents Phoon Chee Kai, 68 and Kelly Moh, 35, said they were tired of battling traffic every day just to access the highway using a longer route that measured 4.5km.

Residents were unanimous in their decision to ignore the calls to stop work and the barriers were removed by 4pm. Re-surfacing work was carried out soon afterwards.

KAJANG: The Selangor Government has given the green light for the opening of the Bandar Mahkota Cheras toll-free access road leading to the Cheras-Kajang Highway.

The Kajang Municipal Council has been given the power to remove the barricade put up by highway concessionaire Grand Saga Sdn Bhd in 2006 due to loss of toll collection.

A date for the opening of the RM16mil road, built by Bandar Mahkota Cheras developer Narajaya Sdn Bhd, will be announced by the council soon.

The go-ahead was given by Selangor executive councillor and State Local Government, Study and Research Committee chairman Ronnie Liu following a meeting at Menara MPKj.

“We are ordering the opening of the road because it is on state land. It has been handed over by developer Narajaya to the council,” he said.

Residents of the township and the adjoining Bandar Sungai Long will benefit from the opening of the road as they have been using the main road meant for the latter.

Bandar Mahkota Cheras Open Access Road Committee members were earlier in pensive mood at the meeting, which was also attended by council president Datuk Hasan Nawawi Abdul Rahman, Cheras MP Tan Kok Wai, Kajang assemblyman Lee Kim Sin and representatives from developer Narajaya Sdn Bhd and the Malaysian Highway Authority.

Committee chairman Tan Boon Wah said it was a victorious moment for residents of both townships and urged residents to remain patient until the date of the opening was announced.

ON Friday, Bandar Mahkota Cheras residents will know if their wishes would come true if the Selangor state government orders the opening of the Bandar Mahkota Cheras access road that was blocked in 2005.

This would depend on the outcome of a meeting between the Bandar Mahkota Cheras Open Access Road Committee, the Kajang Municipal Council (MPKj), the Malaysian Highway Authority (MHA) and developer Narajaya Sdn Bhd.

Selangor executive councillor Ronnie Liu who met with the Bandar Mahkota Cheras Open Access Road Committee members at the state secretariat building in Shah Alam on Tuesday said he would act as an observer.

“We have asked the MHA to attend to obtain a clearer picture of the situation and to find ways to open the road,” the State Local Government, Study and Research Committee chairman said.

Bandar Mahkota Cheras Open Access Road Committee chairman Tan Boon Wah said Works Minister Datuk Mohd Zin Mohamad had assured committee members that he would help open the road.

“The legal suit is between Grand Saga and Narajaya and does not involve the residents,” Tan explained.

Cheras-Kajang highway concessionaire Grand Saga Sdn Bhd barricaded the road in October 2005 citing loss of income from toll collection and this eventually led to a legal dispute with Narajaya.

Bandar Mahkota Cheras residents are now using the access road through Bandar Sungai Long to access the highway.

Traffic congestion during peak hours is a common occurrence.

他說，在暴力事件發生時，他仍在皇冠城封路處，距離事發地點約350公尺，無法看到事發經過。

他指出，他是當天行動的指揮官，故留在封路地點指揮。

沒下令使用暴力

他披露，約凌晨12時至1時間，他看見2名警員，挾扶著一名血流滿臉華裔男子到上警車。

他說，他看見該名男子是有穿上衣服及鞋子。

“我向該2名警員查詢緣由，他們回答說，裡面發生衝突，該男子不知何故跌倒受傷，我立即下令他們送該男子到醫院治療。”

他說，他在現場逗留至5月28日凌晨2時30分，只看到一名男子受傷，並沒有看到其他人。

他披露，暴力事件發生翌日，加影警局則收到2宗有關該暴力事件投報，一宗來自聯邦后備隊；一宗則來自被毆打的司機。

“后備隊向警方投報指2名隊員遭一輛WPD1594的車子撞傷；另一宗則是該輛WPD1594司機，投報遭到后備隊毆打。”

他指出，上述2宗案件已交由馬益再頓阿茲曼首席警長負責調查，至于調查結果如何，他則沒有過問，並不清楚。

警員依哲：逼不得已
適當武力保護自己

第19證人警員依哲指出，警方是基于本身安全，在逼不得已下，使用適當武力保護自己。

他說，當他看到一名後備隊成員跌倒后，他是第一個接近該車子的人，當時該車子打開車窗，他便伸手進去欲關掉車子引擎，惟遭車主阻止。

“之后我想從內打開車門，惟車主立即關上車窗。”

他說，當時該車輛也一直向前衝，令他們覺得受威脅。

他說，較后莫哈末哈密查警長試圖與司機溝通，惟他聽不清楚雙方在討論甚麼。

“之后莫哈末哈密查打開車門，欲把司機拉出來惟不成功，只剝下司機的衣服，期間該司機曾經反抗，用腳踢向警長。”

他說，司機上半身也因此跌在路面上，腳還在車子內。

他指出，後備隊來到后，將司機拉出在地面上，惟不清楚是哪几個成員。

“有几名后備隊成員抬起車子及敲爆車鏡。”

他說，他只看見司機的遭遇，其他乘客如何則不得而知。

他補充，當行動結束，他再次檢查該車子時，發現車匙已經斷了半截，惟不清楚是他還是司機掙扎時弄斷。

警長：使用適當武力
執法員沒暴力對付民眾

第18證人加影警區刑事調查組莫哈末哈密查警長指出，在驅散人群行動過程中，執法人員有使用適當的武力。

他強調，警方並沒有過度使用暴力對付民眾，也沒有毆打民眾。

他承認曾經與一名司機拉扯，不過這是因為該司機不願警方合作。

他說，當他們截停該輛車子時，車子曾經三番四次試圖向前衝，而且也反抗警方，如果司機合作，他就不會動用到武力。

（加影27日訊）加影警方拒絕回答，在皇冠城居民開路風波中被來路不明流氓毆打的流血事件上，是否已逮捕到滋事嫌犯的問題。

加影警區主任沙卡魯丁助理總監今日在警區召開有關警方偵破一個販毒集團記者會時，受詢及皇冠城流血事件中，毆傷居民的流氓是否已被逮捕時，拒絕回答問題。

他說，警方已展開調查，至于是否已逮捕到滋事的流氓，他不回答。

5月27日晚上7時15分，皇冠城至少10名居民在皇冠城主要進出口處，因為推倒大道公司設立的石墩，遭數十名來路不明的巫裔青年以頭盔、木棍及鐵棒追打，多名居民被打至頭破血流。

詢及萬宜國大校園提款機被7名蒙面匪徒切開，搶走約35萬令吉現款事件的調查進展時，沙卡魯丁說，警方只能從萬宜新鎮收費站閉路電視，看見匪車縮影，看不見車牌號碼。

他說，警方已錄取保安人員口供，並還在調查有關提款機銀行所使用的保安公司。

沙卡魯丁也提到，較早時在士毛月被發現的一具女焦屍，至今還沒人認領，警方至今還不能證實死者種族及身分。

（吉隆坡24日訊）高庭今日批准克連沙嘉大道公司，收回阻止雪州加影皇冠城開路委員會主席陳文華，以及雪州行政議員劉天球移走路墩的禁令申請。

大道公司基于皇冠城，銜接蕉賴加影大道出入口的封路石墩，已被移開，禁令申請已成為技術性課題，因而今日決定收回禁令申請。

承審法官拿督阿都華合在各造不反對下，批准大道公司收回禁令申請；但法庭今天未針對此案，作出任何堂費諭令，所以各造負責各自堂費。

克連沙嘉大道公司的禁令，主要阻止辯方移走封路的石墩。

儘管高庭已撤銷大道公司的禁令，但大道公司入稟的主要訴訟，依然存在。

大道公司在訴訟中，把陳文華、劉天球和加影市議會官員，列為第1、第2與第3答辯人。

暫開放皇冠城

克連沙嘉大道公司的代表律師為巴威德仁、陳文華的代表律師是葉文豪、劉天球的代表律師是黃啟斌與郭藝雄。至于加影市議會，今天未有代表律師出庭。

黃啟斌較后在庭外說，目前，其當事人尚未接獲克連沙嘉大道公司，傳遞出的訴訟文件。

他說，若起訴人繼續不傳遞文件給其當事人，辯方將考慮以訴方濫用法庭程序為由，撤銷此訴訟。

5月10日，克連沙嘉大道公司及皇冠城開路委員會，經過多次“開路封路”糾纏，不約而同向莎阿南高庭申請庭令，阻止對方一切封路或開路行動。

開路委員會申請禁令，阻止大道公司封路及須永久性開放；大道公司禁止居民干擾封路工作。

內閣于5月30日，宣佈暫時開放皇冠城，銜接蕉賴加影大道出入口，直至法庭宣判為止。

（加影3日訊）隨著昨日吊走石墩后，克連沙嘉大道公司今日聘請承包商修補皇冠城主要進出口道路，更準備在一星期內在路口增設交通燈，提升該路口安全措施！

該公司負責增設交通燈職員諾丁說，該公司已聘請承包商，修補之前因設石墩而被挖至凹凸不平的道路，並且將儘快增設交通燈。

他說，安裝交通燈的工程或在本週內進行。

諾丁今日與安裝交通燈的承包商到路口察視交通情況，及為安裝交通燈作初步估價后，受《中國報》詢問時如是指出。

增設3盞交通燈

他說，該公司計劃在皇冠城出口路段增設3盞交通燈，即路口前左右2盞主要交通燈，及駛出大道前右邊一盞次要交通燈。

至于皇冠城進口路段，他說，公司將使用現有交通燈加以協調。

“當所有交通燈完成安裝工程，公司將重新調整皇冠城主要道路進出口前整個交通樞紐的交通燈運作，提升該交通樞紐安全。”

他說，安裝工程只需2天，希望可以儘快安裝。

負責鋪路的承包商依拉古說，皇冠城進出口路段都會重新鋪上柏油路以及修補道路分界堤。

他在上週六（5月31日）已完成主要進出口兩邊車道的鋪路工程，至于從蕉賴舊路進皇冠城的路口，及從皇冠城出石廠的路口則于今日繼續鋪路工程。

他在早上9時即抵達現場開工，預料下午3時許可以完成。

“雖然主要進出口兩邊車道已重新鋪路，但中間的道路分界堤還未做，我們會在分界堤修復后，再修鋪道路。”

她指出，在最近州行政議會中，當局邀請克連沙嘉大道公司代表出席開會，以瞭解皇冠城封路的詳情。

雪政府堅持開路

她昨晚出席巴生健身社6週年紀念暨籌募四川賑災基金晚宴上，如是指出。出席者包括雪州行政議員歐陽捍華及劉天球等。

《中國報》針對雪州高級行政議員郭素沁于昨晚的揭露，電訪再那阿比丁。

再那阿比丁堅稱自己對以上事件毫不知情，也不了解有關信函的詳情。

他也聲稱自己對大馬大道局是否曾發出信函，表示不知情。

另外，大馬大道局職員說負責人不在，本報無法求證。

記者聯絡大馬大道局中馬區分局，惟職員指負責人兼主任不在，隨后轉聯絡給該分局主任蘇萊雅，惟對方指此事交由總部監督及協調組主任蘇海米負責。

但當記者多次撥電欲聯絡蘇海米時，其下屬均指他在開會，不方便回電。

馬青團法律局主任顏炳壽今日會見加影警區主任沙嘉魯汀助理總監后，這么轉述。

他說，警方是根據第一個報案，來判斷援引條文調查。盡管如此，接著下來的第2天及第3天另有報案，警方會從不同角度瞭解，有關事件目前已分別交由不同警官調查。

他說，在與沙嘉魯汀會面時，沙嘉魯汀並沒明確表示要用“企圖謀殺”來提控4名青年男女，不過將盡快把報告提呈副檢察司。

他將致函內政部長及警察總長，要求成立專案小組徹查整件事。

他不知道是否用刑事法307條文提控4名人士。

他說，警方接到鎮暴警察的報案，指4名共乘一車的青年男女闖警察路障和撞警察。

沙嘉魯汀接受詢問時說，警方已接到4名青年男女中的一人報案，並已向4名人士錄取口供，而對警方的目擊者，調查警察也會盡快向他們錄口供。

他說，對事發的具體細節不是很清楚，因為當時他在現場時，在另一個角落向國會議員匯報。

他強調，警方派出的鎮暴警察在情況危及時刻及覺得人身安全受威脅時，有權採取自衛行動。

他說，馬青總團中委葉理國已向總團長拿督廖中萊匯報，並指示他前來加影協助。

他譴責警隊中有人用木棍打人的做法屬濫權，他將向人權委員會提呈報告。

他說，警員把法律操縱在自己的手上事件，已引起廣大民眾不滿，事主有很大意願要起訴警方要求賠償，並要求法庭對涉及的警施于比一般賠償更重的懲罰性賠償。

顏炳壽繼指出，他前來加影的另一個目的，是要告知警方，警隊出現爛蘋果，必須要嚴正看待。

他已致函警察總長要求成立專案小組調查，如查證確實，除了採取紀律行動，也將把他們提控上庭，同時也向警方表達事主擬起訴警察的意願。

（加影2日訊）皇冠城4名青年男女共乘的威拉轎車被拖回加影警局后，車主今日檢查汽車，發現車內音響器材及唱機設備不翼而飛。

馬青總團法律局主任顏炳壽指出，若事主在索回有關轎車時，發現有關失物未歸還，會再次協助車主報案。

他笑說，或者是警方拖回有關轎車時，將物件拆下來放在辦事處或儲藏室，等待事主領回時歸還。

這輛黑色威拉，事發時是由傷者曾俊豪駕駛，司機座左右兩邊車鏡被砸碎，車頭及車尾行李廂的車蓋被刮花。

兩邊車身有些地方被敲打到凹陷及被刮花，留下明顯的痕跡。

今日早上到警局瞭解轎車情況的人士包括陳文華、羅國強，傷者陳少明、馬青團領袖羅秋俊、葉坤才、石傳湖及事主的父母親等。

他們皆認為是因蓄意破壞行為所致，否則不可能被嚴重刮花。

顏炳壽已對失竊物件問題向警區主任作了簡報，但沒深入討論。

（加影2日訊）5月27日晚皇冠城封路現場流血事件中，3名被警方援引刑事法148及307條文調查的傷者，今日被召到加影警局，獲延長保釋至本月10日，暫未被控告企圖謀殺。

馬青總團法律局主任顏炳壽今日陪同3名傷者，會見警區主任沙嘉勇汀助理總監。

在這2項條文下被調查的傷者，包括轎車司機曾俊豪（23歲），他今早從芙蓉一間專科醫院出院，陪同3名傷者到場，曾俊豪需在本月11日再到加影辦理延長手續。

顏炳壽說，警區主任告知，內政部長及副部長已傳召他做全面報告，並且作出公正的調查。

他說，警區主任指鎮暴警察向加影警方作出的投報，分別由2名警官調查正；完成調查后，將把報告呈交副檢察司，所以暫未決定提控4名傷者。

他說，馬青團將跟進此案，並歡迎任何有証據的公眾人士挺身而出；他表示，他雖是政黨人物，但會秉公辦理，而非博取宣傳。

他希望副檢察司接到報告后，不要採取提控，否則他將致函總檢察長要求撤銷控狀。

他也傳達當事人要對涉案的警方人員採取起訴行動的訊息，警區主任表示是涉及者的法律權力。

事發后不久，他獲得公眾人士提供一個光碟，內容是事件過程；他必須先向提供者詢問意見后，才決定交給警區主任。盡管如此，他希望人權委員會舉行聽証會了解事件經過。

由馬青法律局主任顏炳壽率領的律師團，將代表4人採取相關行動。

馬青中委葉理國披露，5月27日流血事件發生后，加影刑事調查主任依德里斯副警長指4名男女，即陳少明、曾俊豪、石錦和及曾慧敏在當天共乘1輛轎車，沒有遵從警方及聯邦後備隊的指示，把車子停下接受檢查，反而緊急後退，造成2名警員受傷，警方也因此將援引刑事法典第307（企圖謀殺）條文和第108（騷亂時持有武器）條文調查4人，並將把調查報告呈給副檢察司決定是否提控他們。

馬青律師團插手

葉理國說，馬青法律局律師團認為，4人不應在此2項條文下被接受調查，如果4人被副檢察司控上法庭，馬青律師團將要求政府取消這2項控狀，因為他們根本沒有犯下類似的錯誤。

他說，此外，律師團在4人委托下，將代表他們起訴警方無故毆打司機曾俊豪及對其余3人作出粗暴行為的刑事控訴，同時將起訴政府因為此事而在報章發表不確實言論，進而造成4名男女被誹謗，而要求民事賠償訴訟。

葉理國指出，此事發生后，警方發函給該4名男女，要他們在本月2日（星期一）前往加影法庭，如今警方又要求4人在明日10時前往會見加影警區主任沙卡魯汀助理總監。

無論如何，他說，以顏炳壽為首的馬青律師團，將陪同他們一同會見警區主任。

他指出，馬青總團長拿督廖仲萊也針對此事，指示馬青法律局給予4人全力協助與配合，他也會一同處理以上事件。

他們于本月27日晚上約11時，共乘一輛車，準備驅車離開蕉賴皇冠城封路地段，車子在橋下U轉處險撞到聯邦后備隊人員而遭圍毆。

過后，警方指他們的車子疑致傷兩名聯邦后備隊人員，援引刑事法典第307（企圖謀殺）條文和第148（騷亂時持有武器）條文調查他們。

警方完成調查后，將報告提呈給副檢察司，決定是否提控4人。

雪州皇冠城開路風波中，被居民移開的石礅原本散落道路上，猶如巨石陣，車輛也必須以蛇行方式避開重重的石礅。

由于皇冠城往蕉賴翠蘭嶺的交通燈沒有調整，轉燈時間不一，以致車輛往往停在黃格中，阻礙另一方車輛通行。

（加影1日訊）皇冠城主要道路獲得暫時開放，疏散雙溪龍鎮出口逾萬車次，交通阻塞問題獲紓緩。

在封路期間，每天雙溪龍鎮、皇冠城及友友花園等約10個花園，逾6萬車次，單單是皇冠城就有3萬車次，湧向雙溪龍鎮路口，以前往吉隆坡，以致每天早上皆出現長長車龍，居民需花半小時至1個小時才能駛出住宅區。

惟自開路之后，交通獲得疏散，皇冠城約有1萬之前使用雙溪龍鎮出口的車輛轉而使用皇冠城要道，其余2萬車次都是往加影等方向才使用雙溪龍出口。

根據居民透露，以前他們使用雙溪龍鎮繞道時，往往需要半個至1個小時時間，才能駛出住宅區，塞車情況嚴重。

“走出重圍后，我們得再過2個收費站才抵達隆區，惟開路之后，居民只需花半個小時至45分鐘時間而已就可抵達，而且只需付一個過路費。”

他們透露，自從開路之后，在上下班時間，過多的交通流量導致出現塞車的情況，往往車龍只有區區1公里，比之前繞道情況改善許多，所以居民們都甘之如殆。

交通燈操作有問題

根據記者在現場觀察，由于皇冠城（原本封路路段）往蕉賴翠嶺鎮或吉隆坡方向交通燈沒有調整，以致該路段經常出現塞車情況。

當封路路段的交通燈轉青時，往蕉賴翠嶺鎮或吉隆坡方向的交通燈也同時轉青；可是，蕉賴翠嶺鎮或吉隆坡方向的交通燈也轉紅時，封路現場的交通燈依然顯示青色。

由于兩邊的交通燈沒有同時轉燈，導致有些車輛停在黃格中，而尾隨從吉隆坡方向，轉入蕉賴翠嶺鎮方向的車輛也被迫困在其中。

同時，記者也發現部分從皇冠城往蕉賴翠嶺鎮方向的車輛，突然在交通燈前U轉，而在駕駛人士U轉的交通燈柱下，就擺有5個石礅，其中一個就在路旁，可說是相當危險。

石礅猶如巨石陣被擺放在路邊，若駕駛人士不小心或是雨天路打滑，必會撞上。

在皇冠城主要道路上的石礅已移到路旁，唯有一塊石墩則在路口處，駕駛人士在石礅前U轉，險象環生。

皇冠城要道上的石礅已移到路旁，置放在封路地段的交通燈柱下、吉隆坡方向轉入皇冠城路邊，路上也有一些碎石。

居民透露，在雨夜，駕駛人士都難以看到前方的路，或是石礅，所以居民們都會倍加小心，所幸迄今都沒有發生意外。

他們擔心，欠缺耐心的駕駛人士，在塞車時想要插隊，沒有發現路前有石墩而發生意外。

“幸好該路段有燈街照明，只要駕駛人士有耐心，勿插隊，基本上是不會發生車輛撞上石礅的情況。”

皇冠城開路委員會主席陳文華強調，他不曾作出任何有關那個政黨可協助開路言論，這一切都是某報館錯誤詮釋。

他要求有關報館，針對此事慎重做出道歉。

他是針對某報館（非本報）晚報封面刊出，他一開始就沒有找對人，而在委員會尋求馬華雪州主席拿督翁詩傑協助之后，在短短2個星期內就有回應一事，作出澄清。

他說，此報導對他造成的傷害不大，惟卻對曾協助皇冠城開路的有功人士，造成莫大的傷害。

據報導，有關事件是在昨日（31日），由翁詩傑召開的記者會上發生，陳文華強調，他在記者會上從沒有講述本身找錯人幫忙，或是向翁詩傑反映后，在2個星期解決皇冠城封路事件的言論。

他指出，當時他所講的是，只是有任何人可協助開路，他和委員會及居民都無任歡迎。

他說，有關報紙出街后，他接獲許多朋友的詢問電話，令他感到不知所措。

承諾改正還出錯

他說，在晚報出街前，相關記者及一位沒有表明身分的該報館職員向他傳了短訊致歉，並且承諾早報將做出更改。

“可是，我已經看了早報，情況卻沒有多大的變化。”

他指出，報導中，不只引述他講的話出現錯誤，就連相關內容也有錯。

同時，開路委員會秘書陳漢國指出，在皇冠城流血事件中受傷的男女，已經受到某政黨的指示，將大事化小，小事化無，而傷者似乎也不愿將事情鬧大。

他說，如果他們不愿意接受政黨的協助，委員會將把之前居民捐獻的錢協調傷者。

他也要求內政部副部長拿督曹智雄，對其早前發表的警方沒有袖手旁觀言論做出澄清，並且吁某政黨不要這邊廂嚷著要協助，另一邊廂對警方的行為做出否認。

工程部長拿督莫哈末辛昨日在皇冠城封路現場宣佈，內閣決定重開該路段，直到大道公司與發展商之間的訴訟裁決為止。

詢及有人認為內閣這項決定是有其他因素，納吉說，任何人一旦做了違法的事，政府都不可能偏袒他們。

消息說，警方已呈交4名涉及男女，被指撞傷兩名聯邦后備隊人員事件的報告，包含整個事件的來龍去脈。

被指撞傷警員

“由于警察總長目前不在國內，必須等他回來過目報告后，才知道后續行動如何。”

涉及撞傷警員的4名男女，有3人受傷，以曾俊豪（23歲、修車技工）的傷勢最嚴重，修車廠東主陳少明（31歲）及曾俊豪的胞妹曾慧敏，另一名學生石錦和則未受傷。

警方是援引刑事法典第307（企圖謀殺）條文和第148（騷亂時持有武器）條文，來調查這起風波。

雖然如此，內政部消息說，目前政府正在向有把現場情況攝錄下來的人等，瞭解詳情。

消息說，政府已觀看電視台拍攝得的片段及一些照片；惟還要等完整的錄影片段，才能作最后定奪。

他說，皇冠城事件的發生有很多目擊證人，整件事應該依法處理，不能聽取片面之詞，所以唯一的方法就是內政部介入徹查，及全國總警長採取有效行動對付。

挽回公信力

魏家祥今早在馬六甲革成華小禮堂，為《中國報》聯合馬六甲年少情主辦，豐隆保險贊助的“第7屆撒種─全甲小學生寫作康樂營”主持開幕后，于記者會上如是指出。

他說，內閣已對皇冠城事件做出決定，不再封路至法庭裁判為止，目前皆大歡喜，但在歡喜的背后，那幾名被毆的年輕人還要被控，他認為這對在場的民眾是不能接受的，也令人費解。

他說，警方要挽回公信力，就一定要徹查。

他也正式聯絡內政部副部長拿督曹智雄作出反映，馬青譴責傷人者，並認為傷人者應被繩之于法。

他認為，在等待法庭判決時，政府應從法、理、情的觀點著手處理上述事件，以務實角度做估算，包括大道公司本身的法律根據、當年批准大道公司合約情況如何、發展商申請道路有哪些承諾、不收大道收費，是否由政府承擔等等。

他說，無論如何，今天不該是居民來承擔。

他指出，目前居民每天繞道走，增加用油量，這無形中也加重政府的負擔。

此外，魏家祥對有些警官說“難道要從天橋跳下來”的言論感到震驚。他說，警方是站在最前線，也是專業的，如果有騷亂，不要說是從天橋跳下來，即使是刀山，也都要爬上去。

他希望，發展商與大道公司的官司能夠和平落幕，無論結果開路還是封路，不應該牽連居民。

“委員會年多抗戰是為了居民利益及覺得必須受尊重，有鑑于此，居民不應該因為交涉事情而引起任何官司，情理都必須兼顧。”

他重申，對任何一方而言，將事情繁雜化、將暴力因素也注在內，甚至變成單一種族課題，這是不能被認同。

（加影31日訊）皇冠城開路委員會今日鄭重聲明，該會不會再為開路籌款，也不會處理置放在路邊的石墩，公眾受促不要捐錢給任何人士！

委員會主席陳文華指出，昨天傍晚有一群印裔人士在開路現場向路過居民募款，指要處理石墩和鋪路，他強調，開路委員會並沒有處理這些事情。

“昨天工程部長拿督莫哈末辛說將指示大道局負責處理善后工作，因此開路委員會不會再處理，也不會要求公眾出錢處理。”

他呼籲大道局儘快清理這些石墩，以及設立交通燈指揮進出皇冠城的交通。

針對馬青指將為受傷居民提供法律援助，委員會秘書陳漢國促請馬青表明立場，是否支持內政部副部長拿督曹智雄的談話，因為后者之前發表的談話，對居民不利。

他也促請馬青對成立獨立投訴警察行為不檢委員會（IPCMC），表明立場。

他希望首相拿督斯里阿都拉在皇冠城流血事件，及陳文華之前被警方扣留及毆打事件發生后，儘快成立獨立投訴警察行為不檢委員會。

他說，該團過去極力推動公民社會，確保一切以人民利益為先，國家要塑造愛心社會，就應以民為本。

問題未解決

他認為，集團利益和法庭糾紛可以慢慢解決，但人民性命必須優先處理。

他說，在流血事件發生后，該團準備攜帶譴責暴力的橫幅到現場，后來得悉工程部同意暫時開路，而更換祝賀居民的橫幅。

對于工程部同意暫時開路，直到法庭有作出審判為止，他認為問題還未完全解決，為此，該團將與開路委員會配合，收集有關皇冠城主要道路的資料，並向有關單位反映，協助居民爭取開路。

發生4名青年男女被打的U轉路口。

（加影31日訊）一名現場目擊證人陳偉汶（56歲）現身說法，指證皇冠城封路問題發生的流血事件，4名被警方指控企圖謀殺罪的青年男女共乘的威拉轎車，並沒有撞到警方人員。

他說，當時威拉轎車跟在他的車子后面，慢慢從U轉路口駛過朝皇冠城街場方向，不可能撞到站在路口的防暴警察。

陳偉汶（56歲，蕉賴11哩居民，小販）指出，他平時習慣在吃過晚飯后，駕車到皇冠城找朋友喝茶聊天。5月27日晚上11時左右，他與太太及另2名年紀40 多至50歲的男性朋友喝完茶后，欲回去蕉賴11哩時，聽到茶客說皇冠城被封的路口處發生私會黨打人事件，便駕車過去看看。

他說，抵達事發的U轉路口時看到很多人，包括警察，他便把車子停下，詢問路邊看熱鬧的人發生什么事，他被告知前面不可再去，因為有鎮暴隊員在守著，他便欲從U轉路口轉回皇冠城街場去。

他說，當時U轉路口有一隊鎮暴隊員一字排開攔住；當他欲駛過時，其中2人閃開一點讓出一條可以讓1輛車駛過的車道，當時有多輛轎車像他一樣慢慢作U轉到回皇冠城街場，包括4名青年男女共乘的威拉轎車，前面還有2輛，他的車子是跟另1輛花蝴蝶轎車。

內心不安

駛過U轉路口不遠他再次停車觀看，發現一隊約10人鎮暴隊員用警棍拼命敲打威拉轎車，但因為人多，而且有警察盾牌擋住，他看不清楚裡面情況；這時多名警察吆喝他走開，並作狀欲上前來捉他，他又坐上轎車駛前一些，然后再下車，看到五六名便衣人員，不敢肯定是否是警方人員，用木棍打1名躺在不遠的路邊的年輕人，他非常害怕，大喊警察打人，並告訴1名也在此時到來的馬來人。

他說，他在這幾天閱讀報章新聞，指政府高官和警方高層說涉案的轎車撞傷警察，感到很不安樂，而且對警方恫言用企圖謀殺罪對付被警察打的4名青年男女，感到氣憤，認為必須站出來說出真相。

他已在昨午3時向雙溪龍警局報案，說他當時看到的真實情況，不過尚未被查案官錄口供。

（莎阿南31日訊）雪州民聯政府指出，隨著皇冠城開路後，州政府無需再通過子公司間接擁有的股權，召開蕉賴加影大道特許經營權公司克連沙嘉緊急股東大會。

雪州政府秘書署今午針對蕉賴皇冠城封路事件發表文告時說，州政府感謝中央政府和工程局昨日宣佈，允許當地居民繼續使用現有的蕉賴加影大道。

文告說，州政府希望所有居民，尤其是皇冠城居民，能對中央政府的決定感到滿意及接受。

雪州政府也希望工程部今后在其他地區，一旦面對類似問題，能夠作出以民為本的決定。

據瞭解，雪州政府旗下的上市機構雪州柏郎桑集團於2003年上市前，曾擁有克連沙嘉大道公司的42%股權，即Peak Synergy私人有限公司（44.45%）、Europlex財團私人有限公司（33.33%），及Cerah Sama私人有限公司（22.22%）。

雪州柏郎桑集團在另一家上市公司達力（Taliworks）有限公司擁有20%股權，而後者則擁有 Cerah Sama 私人有限公司的55%股權。

許多石墩被扡到天橋旁的道路，至今未移走，阻礙交通。

（加影31日訊）儘管皇冠城主要道路出入通道路已開，惟無人善后，當初封路的石墩仍在道路中央擋路，造成交通混亂，威脅道路使用者安全。

皇冠城主要道路出入口雖然獲內閣允許暫時開通，但今早沒有交通警察指揮或交通燈操作，導致道路合法開通首天交通混亂。

該路口是個十字路口，現有的交通燈操作範圍，不包括進出皇冠城方向，導致從皇冠城駛出大道方向的車輛，必須小心翼翼地和其他方向的車輛“搶路”，才得以駛出大道或通往敦胡先翁鎮。

這也導致從皇冠城出大道的車輛行駛緩慢，車龍長達半公里。

由于多個方向車輛湧入路口前的交通樞紐，以致該交通樞紐非常擁擠，容易發生車輛碰撞，駕駛人士受促展現禮讓精神，以免發生不愉快事件。

滿地沙石

駛出皇冠城的方向車速緩慢，車龍一直都長達半公里。

這條道路自28日晚上開通后，現場留下許多石墩未移走，一些石墩更被拖到天橋下的道路，阻礙交通，也威脅道路使用者安全。

而在開路路口則沙石滿地、垃圾四處，摩哆騎士必須放慢車速，以防滑倒。

居民上一次合力開路時，整條路口全開，不過，今次可能太多石墩，居民只移開封住進出路口的石墩，從蕉賴舊路駛入皇冠城的進口以及皇冠城駛出石廠的出口都沒有打開。

根據開路委員會主席陳文華透露，工程部已指示大道局在一週內，清理所有石墩，恢復路況。

向加影市會反映

我們已派員到現場巡視情況，並會持續到當地巡邏，監視該道路的交通情況，一切情況都在控制中。

有關擋路石墩不是我們的責任，居民應該向加影市議會投訴，以便有關當局派員清理。

公共工程部長拿督莫哈末辛說，政府將會在法庭裁決后，檢討這項決定。

他今午3時30分，為皇冠城居民捎來好消息，指大道特許經營公司克連沙嘉，也同意在這段期間，不在出入口處設路墩阻止居民使用，這個通道暫時充當公共道路。

數百名皇冠城居民在細雨中，聽到這項好消息時，都高興得歡呼起來，並看著鏟泥機將路墩移走。

莫哈末辛說，由于開放這個通道給皇冠城居民使用，將涉及每天9000令吉，或1年350萬令吉的大道收費，因此，政府暫時無法決定永久開放這個路段。

覓永久解決方案

皇冠城開路委員會主席陳文華被居民抬起，為內閣決定讓皇冠路開路一事歡呼。

莫哈末辛強調，政府承諾會尋求方案，永遠解決此問題。

“政府保證會尋找永久解決方案，給我一點時間。”

部長指出，內閣基于雙溪龍商業活動頻密，導致交界處交通阻塞，及為當地居民帶來方便的因素，決定暫時開放這個路段。

他說，由于皇冠城發展商Narajaya有限公司，已入稟法庭起訴克連沙嘉，吉隆坡高庭將在6月25日重新過堂，因此，居民受促遵守法紀，耐心等待法庭裁決。

“當地居民受促不要受任何一方影響，而趁機製造混亂，影響安寧。”

道路打通了，但用來封路的大石塊卻被隨意遺置路中，危害道路使用者安全。

克連沙嘉昨日已與部長會談，為封路風波尋找解決方案，部長今天宣佈解決辦法。

克連沙嘉在過去數週，以皇冠城主要通道是非法興建為由，關閉出入口處，居民與大道公司隨即上演“你封我拆”戲碼。

結果在皇冠城居民在28日晚，企圖推倒6尺高石墩時，與滋事者發生衝突，造成流血事件。

Narajaya有限公司則強調，該公司推出皇冠城房屋計劃之前，已獲當局批准興建1條衍接蕉賴加影大道的道路，即該公司比大道公司更早取得批准。

他笑言，居民期望發展商與大道公司的訴訟案，一直拖延，此路就可無限期開放，否則又恢復沒路可行的日子。

此外，民主行動黨沙登區國會議員張念群認為，只要中央政府願聽民意，相信就有辦法永久開放皇冠城主要出口路段。

3名目擊居民包括來自皇冠城第8區的黎偉昌及2名在籍中學生，由于還在求學，2名中學生要求媒體故隱其名。

目擊的中學生指出，他和一名同學于27日晚上經過該處看熱鬧。他們是走在鎮暴隊后面，突然看見一輛威拉轎車很緊張的U轉，撞上前面另一輛車，但沒撞到鎮暴隊成員。

他說，2輛車碰撞后，被撞的車駛離現場，之后有一大群鎮暴隊成員包圍著威拉，然后敲打車窗，他聽到他們叫司機（曾俊豪）停車。

他指出，當時鎮暴隊伸手進車打司機，之后把司機拉下車繼續打，司機在車上時遭鎮暴隊員打，被拉下車后，遭2、3名沒有穿制服的男子圍毆，當時司機沒穿上衣。

他說，司機在車內被打時曾企圖逃跑不果，當時現場至少有10名居民在場；他很怕被打，一邊看一邊退后。

目擊者黎偉昌指出，他當晚與雪州行政議員劉天球報案后，11時30分返回封路現場。

“當我們接到鎮暴隊會在凌晨12時驅趕人群，11時45分準備從皇冠城主要道路前往封路的方向U轉處，U轉回皇冠城。”

他說，當時很多車塞在該處，車速每小時不超過10公里，曾俊豪根本不可能撞警員，因此，他認為企圖謀殺的指責絕不存在。

“當時我的車和載有4名男女的威拉轎車，大約有5輛車的距離；我聽到敲擊聲下車查看，看到曾俊豪被拉下車，一名相信是便衣警員的男子用腳踢曾俊豪，當時曾俊豪的衣服已破了。”

他指出，當時已倒在地上曾俊豪嘗試爬起來，鎮暴隊成員卻手持塑膠盾攻擊他。

“此時曾俊豪大喊‘不要打，警方是流氓’，該名動粗的警員略為停一停，我覺得自己也幫不到什么，之后便離開了。”

當他準備U轉時，看到數名便衣警員及大批鎮暴隊成員，便衣警員還以非常挑釁的語氣，叫居民“回家睡覺，不要來這裡！”

居民唐梓臻強調，事發當天從早上到晚上，都有警員在場監督，卻沒有及時阻止暴徒行兇，這不是袖手旁觀嗎？

他說，當天高架天橋上至少有5、6名警員監督現場情況，警方巡邏車在暴力事件發生前也在現場。

“居民在早上已致電加影警局，指有私會黨插手此事，要求警方派員到場，下午6時，居民再向武吉阿曼警察總部投報，警方有責任馬上採取行動，但到了下午7時15分仍發生暴力事件。”

他指出，當暴徒驅趕及毆打居民時，警員在高架天橋上面觀看，居民希望警員阻止暴徒，結果令居民失望。

他希望一直在現場執行任務的政治部官員，在寫報告時，能公平寫實的把真相呈給部長，部長也不該在事件未查明前就下定論。

唐梓臻今日在一群居民陪同下，在記者會上如是指出。

唐氏也強調，皇冠城居民在此事件上只純為開路，談不上企圖謀殺警員。

“居民不反對警方執行任務，但絕對反對警方濫權及使用暴力對付手無寸鐵的居民。”

他指出，鎮暴隊打人的案發過程已被人攝錄下來，並且已上載到 www.youtube.com，希望內政部據實及公平作出報告，4名男女是否如警方所指般企圖謀殺警員，讓此事儘早真相大白。

逾20名暴徒持械沖進來，見人就打，更追打居民追到300公尺遠，至少30名居民掛彩。

案發時至少有四五名制服警員在天橋上觀察，同時也有警車開著藍色旋轉燈。

事發前，一輛警方巡邏車停放在靠近封路路口的皇冠城牌坊下，但當暴力事件發生時，警車卻“失蹤”。

現場早就有警員在場，但警員沒有做什么，還不算袖手旁觀？若有需要，我愿意向警方供證。

警察只看沒行動

我6時許抵達現場，看見一輛警察巡邏車停在皇冠城牌坊下，車上坐著兩名警員。

天橋上也有兩名警員，我看到天橋上警員和巡邏車內警員打手勢溝通，但不知道他們傳達什么訊息。

不久，居民開始推石墩，接著發生暴力事件。

當時居民紛紛逃走，我與數名馬來婦女逃到隔壁的馬來甘榜。

我看到暴徒搶攝影記者的相機記憶卡及一名居民被追毆，打到斷手。

混在人群中的警員，他們應該知道該怎么做。

我6時45分到現場，隨行的一名女同事留在車內，我走到路口看見有一名安娣在拆木板，居民開始推石墩后就發生暴力事件。

當時幾名暴徒驅趕居民，我以為是便衣警員，后來看到打人才知不妙，我見形勢不對逃離現場，看見警察在天橋上。

我退到遠處和其他居民談論時，突然想起女同事還在車上，由于女同事不會駕車，我馬上回頭找車，這時我看到天橋上的警員還在。

從我逃離現場回去取車，至少也花上15分鐘，但天橋上的警員還在原地。

雪州加影皇冠城銜接蕉賴加影大道的主要道路，由發展商建好后，原擬開放通車；不料大道公司以開放主要道路，將造成駕駛人士選用交替路，不使用其大道，而令其蒙受虧損為由，封鎖通道，並向政府要求4億4200萬令吉賠償。

（吉隆坡30日訊）“先有雞還是先有蛋”，皇冠城發展商和克連沙嘉大道公司，迄今仍堅稱自己最先建路，雙方皆不願就開放銜接道路及賠償糾紛讓步。

隨著皇冠城開路風波升級為流血事件，發展商和大道公司分別發出文告給媒體，皆以本身是先建路者為前題，闡明本身對皇冠城銜接道路的立場。

雙方糾紛始于1994年，發展商指出，他們早在推展屋業計劃時，已獲得政府批准，興建銜接道路至主要大道（加蕉大道），大道公司卻說發展商是在大道計劃獲批后，才呈上建路申請書給大馬大道局。

大道公司今日透過事件演進表，指大道局當初已闡明發展商要建路銜接大道就得賠償，發展商也以書信方式回覆願意作出賠償，更以此路作為產業促銷賣點。

大道公司基于發展商違背雙方協議，沒有發出賠償就擅自開放該路通車，于2005年建設路墩封死通道，引起居民極度不滿，開路鬥爭也由此開始。

文告指出，居民曾于2006年展開請願行動，並到國會及布城首相署呈交備忘錄，發展商則于2007年入稟法庭起訴大道公司，開路委員會于5月再度入稟法庭禁止大道公司封路，但被駁回。

根據文告，居民若沒人在背后撐腰，絕不敢一次又一次地拆毀大道公司合法建築的封路石墩。

大道公司也促請居民不應把矛頭指向他們，因一切源于發展商，更倜侃發展商一般都喜歡使用接到居民律師信就宣佈關閉的伎倆，以逃避責任。

發展商：歡迎起訴

皇冠城發展商指出，若大道公司認為他們違背協議，可採取法律行動起訴他們，沒必要建築路墩封死居民的路。

發展商說，他們早在推展皇冠城屋業計劃時，已獲得相關政府單位的批准，與建道路銜接主要道路（加蕉大道），比大道計劃更先獲得批准。

發展商續稱，他們是在符合大道局條規下興建此路，並一切以居民利益為重。

發展商指出，大道公司自認此路將讓大道流失川行車量以致虧損，而阻止此項工程。

發展商強調，若對認為此道路工程有錯，可對各涉及單位包括發展商採取法律行動，對方無立場封路。

另外，發展商對日前暴徒出現封路現場一事深感憤怒，也不會寬恕任何涉及此事的單位

週二（27日）晚上約11時，4名受害者稱，他們準備驅車離開蕉賴皇冠城封路地段，車子在橋下U轉處險撞到聯邦后備隊人員而遭圍毆。

警方昨日援引刑事法典第307（企圖謀殺）條文和第148（騷亂時持有武器）條文，調查該4名男女，因為他們的車子疑致傷兩名聯邦后備隊人員。

《中國報》今日重回現場，抽樣訪問當地居民，他們皆認為，警方處事方式過于強硬，當局不應該在未調查清楚事情真相前，即宣佈提控該4名男女。

他們強調，如果警方不相信受害者所言，無意致傷兩名聯邦后備隊人員，現場擁有百多名目擊證人，他們都可說出當時的情況。

“警方的行為是不可理喻，4名受害者車上根本沒有武器，更沒有殺人意圖，當局卻以有關罪嫌提控他們！”

居民強調，發生流血事件當天，現場出現10多名暴徒到處毆打居民，警方竟然站在天橋上“觀看”，沒採取任何行動。
